REDWOOD CITY -- Scott Peterson is a cad not a killer, his defense attorney said Wednesday as he began an assault on the very essence of the evidence against Peterson -- when his wife and child died.
In the scenario cast by attorney Mark Geragos, the child was born alive weeks after Christmas Eve 2002, the date prosecutors say his mother, Laci Peterson, had been killed.
"If this baby was born alive, clearly Scott Peterson had nothing to do with this murder," Geragos explained to the six men and six women of the jury. .......

REDWOOD CITY - Saying Scott Peterson was "stone-cold innocent," defense attorney Mark Geragos blasted the police detectives Wednesday who investigated the murder of Laci Peterson and the thin case he said they cobbled together against her husband.
In his first chance to lay out his side of the case, Geragos said Modesto police believed early on that Peterson had something to do with his wife's Dec. 24, 2002, disappearance and they worked to prove only that. Through slipshod detective work, lies and far-fetched theories, they built a laughable case from circumstantial evidence that led to the prosecution of an innocent man, he said.

REDWOOD CITY -- The same gravity that is holding together the "12 galaxies" apparently had enough pull to draw San Francisco's eccentric sign-toting icon, Frank Chiu, and others looking for a little collateral publicity, to the Redwood City Courthouse on Tuesday for the start of the Scott Peterson murder trial.
Parked near the courthouse in a van covered with biblical and anti-abortion messages, Ronald Brock of San Diego sought attention for his message that killing an unborn child, through abortion or any other means, is a crime.
"Murder is murder, give Conner justice," read a banner on the van. Conner was the name Scott and Laci Peterson planned to give their unborn child before a pregnant Laci disappeared in late 2002. Her husband is facing two counts of murder for their deaths.".....

1:23 p.m., PDT: REDWOOD CITY - Scott Peterson had nothing to do with his pregnant wife’s murder - and his legal team will prove it, defense attorney Mark Geragos declared dramatically this morning during his opening statement.
“The evidence is going to show clearly, beyond any doubt, that not only was Scott not guilty, but stone-cold innocent,” Geragos told jurors.
Peterson, 31, of Modesto, came under media and police scrutiny after Laci Peterson vanished Dec. 24, 2002. But Peterson had no opportunity to kill her and their unborn son, Conner, Geragos said.
Evidence will show the baby was born alive, the Los Angeles lawyer announced in a series of revelations. They include:
Laci Peterson knew that her husband bought a fishing boat shortly before she vanished - and “was in the boat Dec. 20.”

Mmmmmm perhaps someone who doesn't think Conner was a human being. There are plenty of those folks out there.

Remember how you felt when the O.J. Jury came back, about the Judicial system? Sure the Jury was blamed..but really, to me, it was SLICK lawyering along with a "pay back Jury" that did it. Now we have the "vomit of the club", defending the "Jackie look-alike", and the commentators telling us just how wonderfully SLICK he is !!! How you as a Defense Attorney bob and weave your way to your ultimate goal of presenting your client so to put reasonable doubt in their mind? On Greta last night, someone mentioned CYRIL WECHT, and said about CONNOR being born weeks before by live birth, as Garagos is claiming...that WECHT would NOT testify for the defense(apparently his choice), after examining the body. They said in argument, that "THAT TELLS YOU SOMETHING ABOUT GERAGOS' CLAIM ". I tend to agree with that.
Oh, and one more thing. Most commentators I have seen on all networks, have said that the state compared to Garagos, is likely to lose. He is just too good . Real encouraging ! I ask myself, if I were a juror, would I be honest enough NOT to watch t.v. at the end of the day ? How much a percentage of them watch ? Hmmmmmm.
Yikes! I have been hearing exactly the opposite. The attorneys on Greta last night were all vey critical of his opening statement. Feiger even got up and pointed out that Geragos was stupid enough to promise the Wynona Ryder jury that he would provide the receipts for the stolen merchandise. He never did!
I think that Geragos is one of the most inept attorneys in the state of California. And I am not saying that because I disagree with him ideologically.
He also counciled Susan McDougal very poorly IMO.
Oh, you're talking about that Dr. Spitz, aren't you? I got to see him on TV, late last night (the Abrams show you're talking about).
Dr. Spitz was reminded by Dan that he had, early on, publicly concluded that the tape tied around the baby's neck must've been put on there by human hands.
He very emphatically retracted that position: last night, I heard him say that he now definitely believes that the tape was indeed debris that the baby's body got tangled in, and he is adamant that the tape was NOT placed there deliberately.
Spitz explained that he was sort of jumping the gun in his earlier statements, but that now that he'd had time to really get the facts, he knew the tape wasn't put on the baby deliberately.
Ewwww! Hey, he might get caught in her oxygen line and disconnect it, if they aren't careful!

Peterson's Own Family Is Cooking His Goose!
Beth K reports that Peterson's family is acting very inappropriately in court. She made it sound like they think they're at a World Wresting Federation event -- ribbing eachother, laughing inappropriately, snickering, acting like the whole trial is just a joke.
I think the joke's going to be on them.
Psychologically speaking, I think what's happening is that if they face the truth about Peterson, then they have to face the truth that they're RELATIVES of a ruthless, hateful double murderer.

Dr. Spitz is the one I have been referring to Dev. He's great. Before he was only going on a description. He can NOW see. He's the specialist I was hoping that the Prosecution had. And I must say, I AM DELIGHTED that Cyril Wecht won't testify. I can retain a little faith in his credibility then. Dr. Lee WILL of course do his charade!! Make no mistake you guys, Geragos AND the Petersons are at some point going to turn this jury off. They are a collection of the most Classless putrid people I have ever watched.
