I would think that the prosectors would have checked this out long ago and not gone forward with the case if there was this doubt.

I think you are close, but not quite there. A prosecutor would prosecute an innocent man, but NOT if he knew there was info favorable to the defendant that was bound to become public knowledge. Such prosecutors are usually evil (ambitious), but not stupid.
