Judge Dismisses Florida Voting Lawsuit

FORT LAUDERDALE, Fla. (AP) - A federal judge Monday threw out a Democratic congressman's lawsuit demanding that Florida's new touchscreen voting machines issue a paper receipt.
It was the second time Rep. Robert Wexler was turned back in his legal challenge of the machines. A lawsuit filed in state court was dismissed in February, and Wexler has appealed.
In dismissing the federal complaint, U.S. District Judge James Cohn said he cannot get involved because the issue is being considered by the state courts.
Also, Cohn said the lawsuit would require the federal courts to become deeply involved with election procedures, which typically are left to the states.
Several Florida counties spent millions on the touchscreen systems after the 2000 presidential election fiasco, in which thousands of punchcard ballots were improperly marked. George W. Bush beat Al Gore by 537 votes in the state after a turbulent recount.
Wexler argued that without a printout, voters in Florida's 15 touchscreen counties are being denied their right to have their votes accurately recorded, reported and recounted if necessary.
The congressman's complaint in state court was thrown out because the judge ruled that Wexler could not show that he had been injured by the voting system.

Just because the RNC is in power does not mean these machines cannot or WILL NOT be manipulated to suit one side or the other.
Remember - Communism is the perfect form of government - unfortunately, people are far from perfect.
Wexler is my former Congressman before I moved to Las Vegas at the end of last year.
I have to say that I agree with him on this issue.
Believe me it hurts to say this after having protested his Boca Raton office so many times!
I would want a receipt also.
Especially if I lived in a county controlled by Democrats.

I made a mathematical proof that 2 + 2 = 5 years ago. It took almost 10 pages of computations and formula and it gave me an A in that course.
Then I had to tell the teacher where the error was because she could not find it. Somewhere around page six or seven (can't remember) I gave a mathematical non-statement that 0 = 0 (this cannot be proven just as infinity = infinity)
What the above means is, code can be written for these machines (and has already been proven) that will give you the results you want. Once a vote goes into these machines, HOW do you prove it was counted? ... correctly that is.

That being said he is correct. How do you verify a recount? What do you do if your computer crshes in mid-day or a voltage spike wipes out the computer altogether?
Now vote tampering will be in the hands of anyone who can hack the programs. It could all be done from Washington or Dakar. It is out of the Dems' control for the moment and they don't like it.
That does not make these things good for the Republicans either, though. Same reason. With thousands of individual hackers and organizational ops taking on this new challenge there will be voting fraud and no one will be able to prove it or know where it comes from.
As for the machines that aren't hooked up electronically to anything, the task will again be the responsibility of the ward bosses and mayors and suchlike folks. They just have to tweak an algorithm in each box, just like running a spike through the punch ballots.
I remember one of the arguments against a receipt was the possibility of someone selling their votes. They would take the receipt and go to whoever is paying them, show them the receipt to prove they voted a particular way as requested, and then collect their money. I believe this would indeed happen. So I am not sure about the receipt, unless you could not remove the receipt from the voting place after you voted. However, I must say I do not trust all the elections board from doing illegal tampering with these new fangled computerized voting machines, so maybe receipts would be the answer. I just do not know..
I can prove any real number = any other real number in 4 lines. There is no error in it, no dividing by zero or any other nonsense.

I agree with Wexler that every voter should be provided a receipt showing:
1. Name
2. Address
3. Fingerprint scan
4. Votes cast
A duplicate of that receipt is retained by the polling authorities for 2 years, in case a thorough recount is needed.
Wexler wants that, right?
