There used to be similar oaths for public employees in the '50's. They were called Loyalty Oaths and were eventually deemed to be UN-constitutional by SCOTUS.
It's a Catch-22. It's "constitutional" to be against the Constitution, even if you swore to "preserve, protect and defend the Constitution". As an elected public servant it is your duty. As a citizen, however, it violates your individual constitutional rights to infringe on your activities to destroy the same Constitution that created your position as a member of Congress in the first place.
