Received another letter from Gannett Publications, publisher of USAToday, and several other newspapers. Due to contractual arrangements they have with third-party content providers, they have denied our request to allow posting of excerpts. They will only allow the posting of titles and links.

Please do not post full text or even excerpts from the following Gannett Web sites:

In order to protect Freerepublic LLC from lawsuits and Copyright infringement issues:

1. Join Google mail...1 meg storage

2. Cut and paste 'News' article into e-mail.../ ...send to self.

3. Either re-write/paraphrase, or do-not atribute ...a 3 or 4 line semi-quote, preceeded by {ie}.

4. get tired of all that...

This is just plain BS, if you ask me.

It seems there is someone who may be out to get FR by sending e-mails to them about the use (and that's fair use, by the way, Jim) of articles being posted here.

I can only think of one person who would do something like this, as he has openly bragged about "sending e-mails all over the place" regarding this website.

Jim,
I suggest that you merely run a program that checks each new posting, scanning for the URL to these sites. Then (if it can run dynamically) block the post, otherwise (if after the fact) replace the post with a standard 'block publication' notice.

Have you explored the possibility of a declaratory judgment actions to resolve the scope of "fair use" here? It's got to be bigger than titles and hyperlinks. Or is it too risky to find out "the rule"?

I sure hope so. Here is my $0.02.

The strategy has to have multiple parts. Part 1 must be to CYA until we are safe...we have to play by the rules. I would think this probably means some sort of bot limiting posting of content from restricted sources.

Part 2 is to set the stage legally. This means several things, one of which is to choose the jurisdiction in which you want to fight. A second, is to find a legal representative. This may mean legal freepathons, or better yet, approaching a conservative public interest law firm like the Institute for Justice. Another, and this is something FReepers can do better than anyone else on earth, is criticize them. Many FReepers frequent 'liberal' sites like DU. Anytime we notice a post from someone who has restricted us, send them notice, CCing FR. Build an archive of notifications of violations. If they do not aggressively protect their copyright, they have no grounds to stop us. This will cost them time, money and effort and aggravate other leftist sites.

Stage 3 will be gradually reinclude their content here. The first phase of it might be to post excerpts, then have forum members (or better yet, bots posing as forum members) post additional excerpts. As long as we have a substantial series of notifications of other sites, they will have little ground to stop us.

Stage 4 will be the actual litigation. With proper preparation, we can ensure that we have won before we set foot in a court.

Ultimately, I think what we do is very clearly entirely under fair use. And I am confident that the USSC would agree. However, I have serious doubts about other courts (9th circuit clowns). However, with proper preparation, FR will be able not only to protect itself, but to help the cause of freedom in America for all. But a big part of that preparation will be to ensure that we have the monetary and legal resources to go all the way to the top if we have to.
