Canada prepares to enforce Islamic law

Canadian judges soon will be enforcing Islamic law, or Sharia, in disputes between Muslims, possibly paving the way to one day administering criminal sentences, such as stoning women caught in adultery.

Muslims are required to submit to Sharia in Muslim societies but are excused in nations where they live as a minority under a non-Muslim government.

Canada, however, is preparing for its 1 million-strong Muslim minority to be under the authority of a Sharia system enforced by the Canadian court system, according to the Canadian Law Times.

Muslim delegates at a conference in Etobicoke, Ont., in October elected a 30-member council to establish the Islamic Institute of Civil Justice.

The institute is classified in Islamic law as a Darul-Qada, or judicial tribunal. Its bylaws are scheduled to be drafted and approved by Dec. 31.

Cases will be decided by a Muslim arbitrator, but the local secular Canadian court will be the enforcer.

One of the obstacles to establishing the system, the Law Times said, has been the Muslim communities' lack of unity and organizational strength. Muslims in Canada come from many different countries and different schools of Islam. Also, there are few Islamic legal scholars, known as ulama, in North America, which are essential to adjudicating complex issues.

"It seems as if the community was looking forward to something like this," says organizer B. Husain Bhayat, according to the Law Times. "If all groups are represented, with hard work and the unity we saw here, we will have no difficulty going forward."

The two main streams of Islam, Sunni and Shi'ite, were represented at the conference, along with imams and leaders of organizations.

Not that I agree with it, but it's in keeping with Canada allowing Jewish and Native Indian courts to apply their versions of law upon their constituents. Pretty soon Canadian law can be thrown out the window as all citizens will be subject to what promises to be a myriad of special interest group laws...well, I guess except in the case where one group offends against another.

The question I'm gonna pose is in no way condoning this idocy, but what is the working definition of "what is a Muslim>"..I mean, can you just profess that you are..do you have to have a beard..memorize the KOran..if you drink or smoke, are you out...?

This article is a bit misleading; see the Independent for a better account. What they are implementing is essentially a voluntary form of arbitration for certain civil matters. This doesn't mean Canadian law will be thrown out -- rather, that in civil matters, you can choose to be governed by some other law instead.

If two people sign a contract, they can voluntarily agree that any disputes will be resolved by an arbiter or their choice, including people like Judge Judy or the local Imam. What's wrong with letting people decide they want their personal disputes governed by Talmudic law instead of English Common Law? The less business that occurs in front of the usual court system, the better.

I recently signed an employment contract with an American company. This included a clause similar to "any disputes will be resolved by an arbiter (selected by them) belonging to [some organization of arbiters]". If I didn't want to be subject to such arbiteration I had the choice of not accepting the job.

I think I'll go to Canada with a few like-minded souls and apply to have the civil government administer justice to us according to our laws (e.g. it is forbidden to pay more than 1% of your income in taxes, every head of a household must own and maintain proficiency in the use of weapons, and whatever else along these lines I can think of).
