A Commission passed into law by congress and signed by the President is executive per se.
It is a legislative investigatory commission.... sorry. Read the enactment...... It's not the Executive Branch doing the investigation in these hearings.

As I heard it, the words "It's scary" were said by someone else in response to j f'n kerry's remark. Those words have been widely attributed to him but I don't think correctly so.

Here's how Public Law 107-306 specified the composition of the Commission:
SEC. 603. <> COMPOSITION OF COMMISSION.
(a) Members.--The Commission shall be composed of 10 members, of whom--
(1) 1 member shall be appointed by the President, who shall serve as chairman of the Commission;
(2) 1 member shall be appointed by the leader of the Senate (majority or minority leader, as the case may be) of the Democratic Party, in consultation with the leader of the House of Representatives (majority or minority leader, as the case may be) of the Democratic Party, who shall serve as vice chairman of the Commission;
(3) 2 members shall be appointed by the senior member of the Senate leadership of the Democratic Party;
(4) 2 members shall be appointed by the senior member of the leadership of the House of Representatives of the Republican Party;
(5) 2 members shall be appointed by the senior member of the Senate leadership of the Republican Party; and
(6) 2 members shall be appointed by the senior member of the leadership of the House of Representatives of the Democratic Party.

Actually, I disagree with you. Aside from your smarmy little side slap at the President, the letter from Tom DeLay to Commission Chairman Kean - was not a love letter - and I sincerely doubt it was written without the consent and approval of the WH.
Though people have disagreed with me, DeLay's letter is not friendly - it might be diplomatic - but it's not friendly. As Majority Leader in the House, DeLay can sway a lot of power. This Commission has become a joke.

What's really funny to me .. FOX has not mentioned it today. Nothing. Maybe FOX is suspicious that it's a fake. This is interesting. I'll be looking for reports about this from FOX tomorrow.

Guess I'm a lousy Bush-bot. I don't follow W's principle-void bipartisanship new tone in Washington BS.
Let's say Tom Daschle did appoint certain people [although I doubt it], Gorelick is already claiming she has received threats of violence since "conservatives"(used in an article) have been after her to resign. Maybe she did, maybe she didn't; her statements lay the ground work for the media blitz that "right-wing Bush and Rove are out to get her".
Based on what I've seen with the President and how he tends to bend over backwards to the democrats from time to time, I'd be willing to bet that if the mainstream media picks up on this and runs with it as a witch hunt for Gorelick [based on being liberal\dem, female, in position to hurt Bush\Rice\etc politically], Bush will kill the headlines by allowing the current commission members to stay put, essentially pandering to the Dems and say he's a uniter reaching 'across the aisle'.
Kerry would have a good campaign commercial if the Prez is seen as someone who tried to obstruct the 9/11 hearings by removing members. Bush can't afford to deal with another vulnerability in this election year.
Check out posts 7 and 20 of this thread. That's what I agree with.
I have no hope for this commission to really resolve any issues but will expose us more than anything. I see it as a politically charged circus. It should have been a closed door investigation for the gov't to assess security risks.

I believe that this is less a question of unconstitutional behavior. than a question of egregious, and profound conflicts of interest, e.g. Jaimie Gorelick.
Aside of the fact that she is a highly partisan DemocRAT operative, her testimony under oath is necessary regarding her actions at Justice, as well as the Department of Defense.
The fact that she is a partner at Wilmer, Cutler & Pickering who also represents The House of Saud, is also a clear conflict by the rules of the American Bar Association.
She belongs in the hot seat, under oath, telling how she set up blocks to any investigation that might have stopped the events of September 11th.

Actually, with Buckley v. Valeo in mind, I think the point you raised is relevent. We need to go through this legislation with a fine-toothed comb and find ANYTHING that appears to be "executive" in nature.
Specifically, we need to find anything the appears to be an "enforecement" power in the language or anything that allows the committee the power to seek judicial remedies/relief.
Anything that encroaches on the president's constitutional grant to "take Care that the Laws be faithfully executed" will work.
I'm looking at the subpoena clauses in the legislation -- that seems to give the Commission the ability to seek judicial relief.
Let me know if you find anything.
