California Supreme Court asks what to do with S.F. same-sex marriages

The court would have to decide if the 4,000 marriages remain valid, if they would be automatically be voided or of they could they be voided at some time in the future.
Assuming Newsom's defeat, which many legal scholars predict, the court asked: "Would the marriages that have been performed and registered nonetheless be valid, would the marriages be voidable or would the marriages be void?"
Lockyer has already told the court in briefs that the marriages, which have left the newlyweds in a state of legal limbo, are invalid and that those married should get their $82 fees refunded.

The court has already said it would not immediately decide whether the California Constitution permits a same-sex marriage, as Newsom and others claim. The justices said last month that they might decide that issue if a legal challenge works its way to them, first through the lower courts in a process that could take years.

In PennsylvaniaPHILADELPHIA -- Justices serving on the Pennsylvania Supreme Court were told Tuesday that the city of Philadelphia acted illegally when it extended benefits to registered life partners of public employees. William Devlin, an evangelical Christian activist who runs the Urban Family Council, sued the city over a 1998 bill that grants benefits to registered "life partners" of public employees and also exempts such couples from discrimination and from paying property-transfer tax on sales to their partners.
Upheld by Common Pleas Court in 2000, the Philadelphia law was struck down by Commonwealth Court in 2002. The state Supreme Court agreed late last fall to hear the city's appeal.

That was also thought almost four years ago with the passing of Proposition 22. Those loose politicians need time behind bars to rethink their positions.

It's looking more and more like a case of fraud to me. With 4000 emotionally scarred victims, I'm surprised some enterprising lawyer hasn't started a class action suit against S.F. yet.

That would be the ultimate irony. S.F. gets sued into insolvency by the very people they thought they were "helping."

It's looking more and more like a case of fraud to me.It's obvious that California Supreme Court will chastise Newsome for his lawlessness. A local official has no business defying state law, but Newsome did it to engratiate himself with the local liberal electorate.
I'm eagerly awaiting the first divorce proceedings, when somebody tries to take the fool they hoodwinked to the cleaners for half of what they own.
