That is probably more applicable, though the intent required is arguable lacking in this instance (to impede or retaliate)
I think since it is a political ad, it would be a pretty easy case to argue the intent to actual do the act is lacking. Otherwise why publish it?

AG Ashcroft has received numerous death threats. He is below Rumsfeld in the order of succession and people have been investigated, and if memory serves me right, atleast 1 person is in jail for those threats. Ruins your "too far down the line" argument.
