Man sent to prison for rape

Herbert Lee Hill met a girl at the Jackson County Fair and that night they engaged in sexual relations at a relative's home.

Trouble is, he was 35 and she was 14 -- statutory rape.

"She lied about her age. I can't change that," Hill told Circuit Judge Chad Schmucker on Wednesday. Nor can he undo the pregnancy and son created in the union.

"The tragedy is that we have a very young child raising an infant," Schmucker said, sentencing Hill to one to 15 years in prison. A jury found Hill guilty of third-degree criminal sexual conduct.

Sentencing guidelines called for six to 20 years in prison, because Hill's record includes drug and breaking-and-entering convictions.

The judge, prosecutor and defense attorney all agreed the sentencing guidelines were draconian.

"The victim testified the sexual intercourse was her idea and she initiated it," defense attorney Susan Dehncke said. "He was not out soliciting children on a playground."

Schmucker said having sex with a child is criminal, but he called a minimum six-year sentence "incredibly excessive."

"I don't see you as a risk of repeating this conduct," Schmucker said.

He deviated below the guidelines, he said, because the victim and her family did not want Hill prosecuted or jailed; the victim lied about her age, and Hill said he wants to take part in his son's life.

Hill and the girl met one night at the 2002 fair and they had sex. There was no criminal action until the baby was born in 2003 and the girl sought public assistance. She identified Hill as the father, and a paternity test confirmed it.

Maybe she lied to him about her age, but the fact is that one needs to be careful who they sleep with. I find it hard to believe that ANY 14 year old could pass for too much older than half his age.

That settles it. Every female should be implanted at birth with a computer chip that specifies (among other things) her date of birth. Not only would this keep innocent Lotharios out of jail but it would prevent said females from partaking in underage drinking.

I was at a fund-raiser for a friend in the Virginia House of Delegates. There was one lovely young woman, in a flawless blue velvet "Little Black Dress", perfect makeup, etc. Willowy figure, and everything.

A total stunner. Then her father introduced me to her. She was **12**. I thought the girl was in college. . .

So they put the father in jail and now the taxpayers can support all three of them. Brilliant!

Well, it didn't seem as though this guy was going to pay foe his kid.

Ex-cons should be more careful. They all know prior felony convictions come into play when they are being sentenced.

This is a study in job creation. They created work for the prison system as well as case workers for public assistance. The rapist, the girl, and the child will all receive as much medical care as they desire thanks to the public coffers, probably more care and better care than someone in our ever growing part time working population. Crime pays if you are willing to vote Democratic and will settle for the standard of living provided by the Democrats vision of the social welfare state.

When I was 23 I was at a dance when I spotted a major young BABE who looked to be 21 or 22. I went over and talked to her and gathered she was WILD but young;-) (Yeah baby) Needless to say I was excited about this but I wondered what her age was after a few minutes of talking to her - with definite prurient thoughts in my mind. I casually asked where she was in school praying it would be college. She was in 7th grade (:-0) I beat a hasty retreat. She was built better than 90% of the women I know and had a mature face.

Any young man here would be checking it out SERIOUSLY if they were remotely hetero. (till they found out the age)

I joined the army at 18 and went directly to college on the GI bill afterward, so started my classes as a 23-year-old freshman, though I had some credits for classes I'd picked up in the army, and that experience waived the otherwise mandatory phys ed classes. Nevertheless I found most of the giggly airhead freshman girls just out of high school to be pretty depressing company, and more generally looked at grad students or foreign students for company. Then, since journalism students were required to take some Broadcasting courses for cross-polination, I finally ran across one there with some brains and maturity.

It wasn't until after we'd been going together for about two months that she leveled with me: she was a highschool student, finishing her senior year of high school a year early in the morning, and attending the University afternoons. The occasion that caused her to level with me about her age was her forthcoming 17th birthday. By then it didn't seem to make as much difference.

Eventually, she went on to a career in the Air Force, and felt badly about leaving me behind, so played Cupid and hooked me up with her older sister. The limits of her activity and lifestyle were not defined by anyone else's terms.
