I've listened to Joe Banister speak about his history as an enforcer with the IRS. He's definitely got both feet on the ground, and has not been tagged by his former bosses as a kook. So it would seem that what he's telling America is the real thing. But who else is listening?

"They used IRS financial databases to check on protesters' financial income, audit them and then if possible try to create criminal or financial or tax problems for them purely based on their political position."

I don't believe that this is accurate. According to the Watergate hearings and a history of the IRS that I read some time ago, Nixon planned on using the IRS against war protestors and political opponents, but never did. In fact, I believe that one of the charges against Nixon during Watergate is that he conspired to use the IRS in this fashion, but he was never actually charged with carrying out the plan. Could be wrong about this, but I don't think I am.

On the other hand, it has been documented that John Kennedy did use the IRS against his political opponents, as did Clinton. Which makes me wonder why this guy decided to bring up Nixon...

His "political activity" is telling people they don't have to pay taxes for a bunch of claimed reasons that the courts have ruled against time and time again.

He gets these people fired up saying. "Help! Help! I'm bein' oppressed!" -- then he tags them for donations. What a guy.

If you set up a website and went around telling people that the National Firearms Act of 1934 is unconstitutional (and it probably is), and told them they should cut all their shotgun barrels back to eight inches, you would probably stir up some official interest -- particularly if you cut off all your own shotgun barrels. This is what he has done by making specious and oft-refuted arguments against taxation, while failing to file his own returns.

Either you obey the laws established by the representative government, or you may disobey them to make a point, and suffer the consequences (i.e. Thoreau's night in gaol). What Banister is demanding is that he have the right to disobey the laws without consequence. That is a direct challenge to the legitimacy of the state, a state that 99.999 repeating 9 % believe to be legitimate.

As to why he hasn't been tagged by the IRS as a kook, beats me. He certainly seems to label himself that way.

Bannister is not the only former IRS enforcement officer to reach the same conclusion about the IRS code and how it is misapplied in many cases. He is the one with the highest profile. There are about a dozen like him now. He is NO kook, which is what is giving the agency heartburn.

I have met Joe, he is honest, and furthermore, he is right. I would believe Joe, as opposed to the IRS anytime. The Emperor has no clothes.

The IRS is a political hack group, has been since the beginning, its just becoming more painfully obvious of late.

Maybe, but he's got a lot of guns and jails.

It would be a lot more effective if Joe Banister and the other 'you don't have to pay taxes' people got behind replacing the income tax and IRS with a different method of taxation (I suggest NRST). Of course, you can't make a living doing that.

That is, IMO, the greatest danger in changing the tax system. Getting rid of any government agency, particularly one that gives the degree of power to government that the IRS does, is almost impossible. Not impossible, but very close to it.
