Sen. John Kerry, D-Mass., President Bush's opponent this fall, interrupted his campaign schedule to vote yes on the one-victim amendment. He voted no on final passage.
Kerry will be on TV soon saying I actually voted for it before I voted against it.

Shouldn't the bill be restricted to those fetuses "which had travelled in or substantially affect interstate commerce?"
Murder, as such, is a state crime, so they should need some hook to pull it into federal jurisdiction, and the interstate commerce clause seems to do the trick for just about everything else under the sun.

Dont get your hope up to high, some still have a hard time even calling it a baby.

The key obstacle was an amendment by Sen. Dianne Feinstein, D-Calif., that would have imposed the same tougher penalties outlined in the DeWine bill but classified any attack on a pregnant woman as a single-victim crime, avoiding the issue of fetal rights and the question of when a person attains personhood. Sounds to me like that would run up against the Equal Protection Clause. Then again, I'm not a lawyer, so I just think about these things in a normal, non-contorted fashion.

Remember the early days of the abortion debate when viability was the key term? After all, who would EVER be so heartless as to abort a child if it ever had the LEAST chance of surviving on its own! It sure didn't take long to sidestep that little moral qualm, did it?
