Homosexual Public Restroom Sex Defended In California

Summary: A lawyer defending the "right" of homosexuals to engage in sex in public restroom stalls was on "The O'Reilly Factor" on March 16, 2004.

"The O'Reilly Factor" recently featured a heated discussion between Bill O'Reilly and criminal defense attorney Bruce Nickerson over the alleged "right" of homosexuals to engage in sodomy in public restroom stalls in California.

Police in Fresno, California, recently arrested 40 homosexuals on lewd and lascivious behavior for having public sex in a park. The sting operation was called "Protecting Our Children." Some of the men were found within yards of playgrounds.

Fresno County Superior Court Judge James Quashnick has sided with the defense attorneys who claim that the prosecution of homosexuals is discriminatory because no heterosexuals were arrested for public sex during this sting operation.

Bruce Nickerson claimed on O'Reilly that in California, a public restroom is considered a private area and it is not illegal to engage in sodomy in the stalls. In fact, Nickerson asserted that if a parent or child were to peek into the stalls, "…you've violated their privacy" to engage in sodomy.

According to Nickerson, it's perfectly all right for homosexuals to sodomize each other in public parks "…where you reasonably don't expect to offend anybody."

The effort by homosexuals to have public sex legalized is not new. In fact, in 2001, the Massachusetts Supreme Judicial Court, headed by Margaret Marshall, issued an edict stating that public sex is legal as long as it's discreetly done.

Marshall's ruling came as a result of a lawsuit filed by the Gay and Lesbian Advocates & Defenders on behalf of a homosexual arrested at a rest area for lewd conduct.

In 2000, the British homosexual group OutRage demanded that the British Parliament legalize homosexual sex in public, including public toilets and cruising areas. The government was considering changing public sex laws to make it illegal to engage in public sex only if the sex acts would "alarm or distress or give offense" to others.

The main problem is that the so-called "gay community" does not speak with one voice ... but often out both sides of its collective a**!

The "We're just like Ozzie and Harriet, er, Harry" crowd get things rolling by saying we just want to be treated like normal humans except we don't want anyone to bring up what we do to each other at night.

Then along comes the self-avowed Queers ... who are at least honest about themselves. They believe that sex is an act of revolution against the stodgy status quo. Of course they go on to say that their revolutionary acts should be treated with the same consideration as every day activities ... like going to the restroom.

In the early 1980s, while I worked at San Bernardino County Hospital, a 16 YO male homosexual fell off a tree limb, while sneaking back into his Group-home bedroom from a visit his homo "boyfriend". He broke his back, and was on my unit in a FULL BODY CAST. Between checks, he sneaked out of bed, and out a rear entrance, (we were ground floor) and off the grounds. When, dumbfounded, we realized he was gone, we notified SB police & sheriff. He was found about two hours later, emerging from a van driven by his boyfriend.

Body cast and all, he had absconded, called, met, and had sex with this guy. When questioned, he asked what we expected, since it HAD been two whole weeks since he had had sex, and he JUST HAD to do something about it!

Illicit homo trysts had already gotten his back broken; now, he was risking frther injury or death for more sex, despite a plaster FULL BODY cast!!

BTW, despite his being 16, and a ward of the state, his "partner" was NEVER arrested, let alone prosecuted.

No, not all sex is "equal" when it comes to these people.

I I went into the men's room in some bar to take a leak. To my astonishment and surprise, the guy at the next uriunal reached over and grabbed my penis. It was propably the the last thing he ever grabbed. He is probably still there unless his fag buddies scraped him off the floor.

Suspects in Fresno sex sting win discrimination ruling gives the details.. Apparently there's not even close to a privacy issue, all those arrested were charged for engaging in sexual activity outside of the restroom stalls.

I'm really curious to know if someone in Fresno could pick up the details of the reply by the prosecution to this -- were any heterosexuals observed engaging in sexual conduct? After all, how can it be discrimiatory if there were no heterosexuals engaging in illegal behavor?

I have seen it, but no one should see it. At least the hetero offenders aren't lobbying to have it legalized. If legal it won't just be nightclubs, it will be the toilet at your workplace, too. If you have children you won't be able to take them for a pee at the mall, either.

Not only that, if you have ever watched some of these guys that prowl for Johns and their prostitutes to catch them in the act and report them, heterosexuals seem to favor parking a car in a parking lot out in public and carrying on. Both are disgusting and both are being addressed. I bet this judge and defense attorney don't have an issue with heterosexual Johns and prostitutes being caught "in the act" in automobiles in public places though, nor would they claim it discriminatory if there were no homosexuals caught in similar acts I would bet.
