SIOUX FALLS, South Dakota (AP) -- Bill Janklow was on duty as South Dakota's congressman when his speeding car collided with a motorcycle last summer, meaning federal taxpayers would pay any civil damages arising from the fatal crash, a prosecutor has concluded.

I understand the general principle, but Clinton settled with Jones out of his pocket (nominally), as have other elected officials. The way this story read, the US Attorney inserted himself. I'm curious if Janklow demanded the "defense" be raised.

This is an outrage. It's bad enough that Janklow got a slap on the wrist for causing someone's death. Now, he'll be able to have the taxpayers pay to clean up his mess. Disgraceful.

As of July 29, the House was adjourned and the Senate recessed on August 1, 2003. Janklow, while still a Member, was in fact released from his congressional duties, and therefor on his own time. The Senate only recesses as they can be recalled in an emergency to assist the Executive branch; there is no constitutional requirement for the House to be recalled after adjournment.

Sounds like someone is doing the convicted criminal a favor. I'm aware of VERY few instances where a US Attorney is involved in a civil matter.
