The fact that the Democrats have flip-flopped on their opinion on this matter is immaterial to whether or not the practice is, in fact, Constitutional. This should be determined. The fact that President Clinton did something is rarely used by Republicans to justify that said act is therefore legal or correct. So that's a bit of a flip-flop on their part.

I agree, two wrongs do not make a right. However, it is none the less fun to see the democrats tactics turned around on them.
