LIMBAUGH CASE: JUDGE IN PALM BEACH HOOKED ON OXYCONTIN, REHAB, REMOVED FROM BENCH; NO CRIMINAL PROBE
A Palm Beach Country Judge -- who operated in the same jurisdiction that is current hearing the Rush Limbaugh pill case -- was hooked on OxyContin and forced from the bench, but was never investigated if he obtained the pills legally, the DRUDGE REPORT can reveal.
MORE
Within the last 18 months, Palm Beach Country Judge Robert Schwartz was "involuntarily retired" and removed after he checked himself into a treatment center for dependency of the painkiller OxyContin -- the same drug at the center of the Limbaugh probe.
"He was severely addicted to prescription pain killers," an insider tells the DRUDGE REPORT. "He probably got them from a variety of sources. But unlike Rush Limbaugh, he was never prosecuted! His records do not appear to have been seized nor were his doctors offices raided. Talk about friend of the court!"
MORE
News of the Palm Beach judge's ordeal appears to give credence to Limbaugh's claim that he is being selectively prosecuted.
Palm Beach County State Attorney Barry Krischer refused to comment Friday on the Judge Schwartz/Limbaugh confusion.
Judge Schwartz was hooked on OxyContin for eight years, says a source. He was removed from the bench in October 2002 only after he was unable to hold court, staying in his chambers for several hours a day!
Schwartz suffered from numerous psychological and emotional disorders, including drug dependency, anxiety, panic disorder and sleeping disorder.
Last fall, Limbaugh publicly acknowledged that he's addicted to pain medication and has completed a drug rehabilitation program.
He remains under investigation by Palm Beach County prosecutors for alleged doctor-shopping.
Now if only Palm Beach Country Judge Robert Schwartz was available to hear the case...

As I said on a companion thread that's no doubt been pulled by now due to duplication:

I suspect that Palm Beach is going to quietly drop this as it is anyways.HA! They better not!!! In for an inch, in for a mile!! If they brought the smear and then quietly drop away to the shadows, Rush oughtta pull those bastids out of the shadows and castrate them publicly with the "Nightmare Team" of lawyers.
They can't be allowed to tar him without the goods on one side and slink away on the other.

This just kills me. The judge's problems must have been known by the DA long ago. For whatever reason they open an investigation regarding Rush apparently without considering the effect the information about the judge would have when (or if)it became public. The DA must have been under considerable pressure from the DNC to start the investigationin the first place. OTOH, he may have done it hoping to gather kudos from the Dems and further his political career. This is a big old mess for the DA.

This kind of arbitrary application of the law occurs repeatedly It was prevelent in the division of the New York State agency I worked for. Individuals were disciplined depending on who you knew, what your job was, how well you were liked by the administration, etc. Unfortunately, nothing was ever done about it since lowly employees had no recourse to show the discrimination.

That's exactly right. Selective prosecution is one of the most pernicious practices. It is a direct attack on 'Equal Justice for All', and is especially pernicious when it involves politics. IMO, any law which is not prosecuted, when broken, more than 25% of the time should immediately sunset.

So, the 14th ammendment will put Rush on the Bench!
To: dogbyte12
Not quite.
If the county prosecutor going after Rush was also the same one in power when this judge got nailed, we have a little problem here.
