I think it depends on what basis the appellate judge rules. A substantial portion of Blacks appellate brief deals with privacy issues and scope. On either of those issues if The judge rules in favor of Rush then the SA's office will have no recourse but to fold it's tents. If the appeal is on procedural grounds then the SA remains alive.

ah...I get it. You were the proto-Ash and I'm the Post-Ash or the NeoAsh? Interesting.

Having only joined Free Republic about 8 months ago I don't know Ash from a hole in the ground.

Whoever Ash was, he/she seems to have left a deep scar on the psyches of Freepers. The Digital Boogeyman. He doesn't sound like a person I would like particularly and I am not pleased by the comparison.

I wouldn't worry about it - I think I may have run across him a few times, but I can't recall- the comparisons seem to be based on someone who uses logic, reason, facts, and a persons own arguments against them - and it helps to be right about 99.8% of the time and be tenacious about it.
I think Ash might have been tossed out as he descended to the level of the mud-slingers when it inevitably started.
A good sense of humor and a realization that anything posted here doesn't mean squat in the big picture is a necessity.

I don't know how to decipher most of this, and no legal type here seems to want to step up and explain what's happening - It seems to me that Black may be the one causing the delay that Rush supporters are complaining about.
