She broke the law in refusing the breathalyzer.

Probably not true. Most places you forfeit your driving privileges however, and that will happen I'm sure.

She should resign.

I just looked it up. It is a civil penalty, not a criminal violation. Refusal does not stop the OWI prosecution in any way. Especially since she was stupid enough to refuse a blood test after blowing .12 on the roadside test.

She will most likely try to argue that the roadside test is inaccurate and that she had had a drink almost immediately before taking the test.
