He's suing him under the Federal Whistleblower statute. By its design it is for occasions where a subordinate thinks that a superior has retaliated against him for blowing the whistle on the superior.

And that applies here how...?

The plaintiff had alerted Congress,(Sen Grassley et al) of what he said was malfeasance on the part of the DOJ in the handling of the case. He said that as a result of that "Whistleblowing" he was retaliated against by the DOJ.
