A federal grand jury Tuesday returned a three-count indictment against Shelby County Medical Examiner Dr. O. C. Smith, charging him with falsely reporting that he was attacked by an unknown person in 2002 outside the Regional Forensic Center.Smith was found bound in barbed wire with a bomb attached to his chest outside the Medical Center building.
The indictment alleged Smith, 51, illegally and knowingly possessed a bomb which was not federally registered to him.
Counts two and three allege Smith knowingly and willfully made false, fraudulent and fictitious material statements to special agents of the bureau of Alcohol, Tobacco, Firearms and Explosives on July 26, 2002, and again on Sept 11, 2003.
His first court appearance will be at 2 p.m. Wednesday before U.S. Magistrate Judge James Allen.
Smith gave investigators a detailed statement after the attack on June 1, 2002. He was found outside the Regional Forensic Center on Madison tightly bound in barbed wire with a homemade bomb attached to his chest.
Federal investigators originally said they believed the attack was by the same person who authored anonymous letters threatening to harm Smith because of his damaging testimony against convicted cop killer Philip Workman.
Investigators at first said it would have been difficult for Smith to stage the attack himself.
In September, Gov. Phil Bredesen abruptly put on hold Workmans scheduled execution.
State Atty. Gen. Paul Summers said at the time that he recommended the temporary reprieve because of an investigation connected to the Workman case. That investigation, it was quickly learned, was the grand jury probe of Smith.
Workman was convicted for the 1981 murder of Memphis police Lt. Ronald Oliver.
In 2001, Smith told the parole board his ballistics and laboratory tests showed conclusively that Workman killed Oliver. The board voted 6-0 to deny clemency.

Yep, The WREG-TV version, a little less detailed than the newspaper account here. But there'll be more about this matter, to be sure.
I wonder if AMW will broadcast a retraction of the original broadcast.
BTW, what's the word on Katherine Smith?
Cold story. I never did get down there to pick up her autopsy report, maybe now would be a good time for a followup. That story comes up for it's 2-year anniversary in a couple of days....
