[history]
Another rank judicial usurpation impends that will prohibit the death penalty for gruesome homicides perpetrated by unrepentant 17-year-olds, like sniper Lee Malvo. Associate Supreme Court Justice Sandra Day O'Connor, whose votes and opinions bespeak political compromise and elite orthodoxies, will probably cast the deciding vote in State ex rel. Simmons vs. Roper to ban the practice as unconstitutionally cruel and unusual. There may be better examples of idiosyncratic policy views masquerading as law, but if there are, they do not readily come to mind.

Judges today are the ultimate branch of government: they make laws, impose taxes, and bring to heel the unwashed masses. So much for checks and balances and the separation of powers.

The death penalty has about 10 more years in the USA, maybe a bit less if Kerry's elected. The elites and their judges have decided, it's being phased out.

Yep. They'll use "salami tactics" to get rid of it instead of ending it in one fell swoop.

Hey, the death penalty had been stopped before by liberals in the robes, but it came back when people were tired of criminals not being punished.

For each year there was a moritorum on the DP an additional 2,000 men, women and children were slaughtered. It didn't start reversing that trend until we reinstituted the DP and added 3 strikes.

So the murder rate went up by 2000 a year because of the moratorium imposed by the Supreme Court? But I have always been told by liberals that the death penalty did not deter crime? Could it be they were lying?
