Palm Beach State Attorney’s Office Dances Atop Their SUV, Releases Confidential Correspondence

Roy Black Comments on the State's Release of Confidential Correspondence

Miami, FL – January 23, 2004 – Roy Black, attorney for Rush Limbaugh, issued the following statement today regarding confidential correspondence that was released to the media by Palm Beach State Attorney Barry Krischer.

“My letter to Mr. Krischer regarding Mr. Limbaugh’s case asked that Mr. Limbaugh be afforded the treatment anyone else would receive. The State's response was preposterous, but consistent with their double standard in this case. The facts are: Mr. Limbaugh went to these doctors to relieve chronic, intractable pain; there was no doctor shopping. Mr. Limbaugh never considered accepting the State’s ludicrous offer. He was not going to plea to something he did not do. We sent them a letter suggesting Mr. Limbaugh be treated in a similar manner that others had been treated. They responded with a preposterous offer. Discussions ended at that time. At no time was there ever a plea agreement of any kind.

"What the records don’t show is that before we could draft a letter responding to the State, we received a phone call from a newspaper reporter, as a result of a leak by the State Attorney’s office, asking us whether Mr. Limbaugh had agreed to enter a plea. As I told the court last month, we think the State Attorney’s Office should be investigated for journalist shopping.

"What is most troubling here is the continued violations of Florida law and bar ethics by the State Attorney’s Office. One need look no further than the bold caption on top of my letter alerting everyone to the confidential nature of the communication. The disclosure of these highly confidential communications violates the Florida statutes, the rules of procedure and evidence, and the Florida Bar Rules governing professional conduct. Because the State has no case against Mr. Limbaugh they continually seek to discredit him in the media.”

I heard that and could tell he had something in his mouth. I have access to ditto-cam but didn't use it today. I have heard what sounds to me like the stress of pain in his voice. He seems pretty darn sharp to me but gee whiz why would he be distracted? He's been through re-hab, he doesn't have meds for pain, the FL AG is floating from one contemplated charge to another, the AG is leaking things to left-wing hit-piece journalists, his med. records were subpoened in a case where that's highly unusual ...

He sounds more hard edged to me too and I accredit that to his re-hab experience. He has said it was a tough yet fulfilling experience. He's taking a lot less guff from idiots these day. I like it!

Rush always seems to make what he does look and sound easy. But there are obviously very few who can do what he does. He must be under a lot of pressure to keep all the balls in the air. And even so he does his job.
And he does it very well, still.

If that were true my ex-wife would be in jail. Instead, she spent over 6 figures for 3 years on pain killers, doctors, and pharmacies. She NEVER broke any laws, only our marriage.

I think that is enough punishment.

Rush is the best. He's not right about everything but he's right about more things than anyone else and he can explain things in a way that allows you to think for yourself. In fact he does things in a way that requires that you think for yourself or remain brainwashed.

I think the State Attorney's Office should be investigated for mounting a political witch hunt against a very popular and outstanding major contributor to our country's greatness and survival.

This particular State Attorney really has a "hard on" for Rush in the worst way. My hopes are that somewhere, somehow, the vast legions of Rush's loyal listeners and supporters will make sure our voices are heard.

I am very sorry to hear that. A close friend of mine almost lost his wife that way. She almost lost her life that way. Damn doctors have done it to her twice because she places so much faith in them. The second time was criminal in nature if not in law because they had her records showing her previous addiction and recovery. Seven years of her life lost to both her and her husband.

I think doctors and pharmacies alike should be held somewhat responsible. They know exactly what is happening and seem to turn a blind eye.

Hi genius, I'm thinking no matter what, Golf changed Rush's life for the better. Playing golf expanded his universe of friends and associates. Broadened his interests and I think overall increased his feelings of well being and happiness.

Many guys and gals play golf no matter what kind of pain they are in, because to some golf is life. I'm not a genius as you know since you are, but these are my meager thoughts.

You can't really condemn a man for being addicted to prescribed pain medication and playing golf at the same time.

It was disgusting. At one point she was on about nine psycotropics from her shrink plus coumadin and pain killers and diabetics meds from her regular doc. Neither one bothered to check with the other.

This was through an HMO from her work. She was such a mental mess she wouldn't or couldn't listen to anything her husband said. The doctors had her scared to get off of anything until one night she took too much of something (no one ever figured out what since she had 17 Rx's) and she collapsed.

The hospital took her back to about three essentials like the coumadin and diabetes stuff and within 24 hours she was lucid and feisty for the first time in three years. Trust and fear of these mindless pill pushers is all it took to push her beyond anyone's reach. Bastards is right!

Sheesh! That's going to get everyone sooner or later. I belong to an HMO. I have to go to my PCP for everything. If I need a specialist, I go there, too. And if the diagnosis requires some expensive treatment, I have to get a second opinion. That's 3 doctors, and that's assuming that my PCP referred me to the right specialist in the first place.

Something has been bothering me about this thing with Rush. IMHO, Rush will never get a fair trial anywhere in America, except maybe his home town, even that may be questionable. So what does this State Attorney hope to achieve by wasting an incredible amount of The People's Tax Revenue on persecuting Rush, who hasn't any previous record of criminal activity whatsoever and in a state where no one to date has ever had this sort of scrutiny for such a minor offense.

I mean it's not like Rush is a menance to society, unless they think his conservatism is. If that is the case then they had better put us all on trial with him for being his loyal listening audience.

Oh I think you've got something there. The lead persecutor surely must be looking for a very big promotion if he should be the man to silence Rush's voice. I do not think he is that crazy to plot against Rush on his own without encouragement from his higher up bosses at the DNC, perhaps, the Big Crime Boss up in Harlem.

In the last 3 or 4 years, Rush stopped talking about frequent golf games. He would talk about the big charity events he was invited to, but not much beyond that. And those events would already have been within the pill-taking period.

The President of the U.S. tried to blame "right-wing talk radio hosts" for the OKC bombing. His wife claimed a vast right wing conspiracy was to blame for accusing hubby of having an affair with his intern ... and that it wasn't true!

I also have had chronic back pain for 18 years. I have never taken drugs for it but I have lost a lot of work time for that choice. Years. I do still engage in heavy physical activities and have all along. Some times I end up crippled with pain for days and sometimes not. Life goes on.

Amen. I've been there, and at times it really does hurt. But lots of things in life hurt. I'm not going to question someone else's pain. And I'm not going to excuse someone's illegal use of drugs to alleviate the pain. You are responsible for your own behavior and the consequences of that behavior, intended or not.
