Patrick James Perschke, who has acknowledged shooting to death a Labrador retriever on a Dauphin Island beach in September, pleaded not guilty Wednesday to one count of cruelty to animals and one count of reckless endangerment.
The appearance of Perschke, a 46-year-old Mobile chiropractor, before Circuit Judge Rick Stout this week followed an appeal of his conviction on the two charges in a trial on Dauphin Island in December.
During that non-jury trial, Municipal Court Judge James Lackey found Perschke guilty of the offenses, gave him two 60-day sentences and fined him $1,000.
Stout on Wednesday set Perschke's trial, this time with a jury, for March 22.
According to trial testimony, Perschke was walking on the beach with his wife and three family dogs on Labor Day when the retriever -- named Shiney and owned by Mobile attorney Skip Brutkiewicz and his wife, Fran -- ran up to the group.
Witnesses said that shortly afterward, Perschke pulled a gun and shot Shiney to death. Perschke said at the first trial that he fired the shots because he believed Shiney was attacking one of his three, smaller dogs
(We never did figure out why the chiropractor had a gun so handy on the beach)

It is even worse....
Steele gave Janklow a suspended imposition of sentence, which means he will not go to prison.
No prison...serves it in the county lockup..
But he must serve the jail time and after 30 days he must serve up to 10 hours a day of community service.

Janklow sentenced to 100 days in jail! I bet he doesn't do 100 hours in jail. Janklow's lawyer will go see the judge with a little white envelope and the sentence will magically turn into probation with time served.

That is such a nothing sentence for taking a life. There might be a little sting in it yet. If Janklow could have received more than a one-year sentence, Janklow's status is that of a felon, as the feds reckon it.
The result may be the end of his political opportunism, and with any luck, the Jeffrey Dahmer precedent may also apply.

Light sentence... on the other hand, he has gone from political legend to disgraced criminal. I can see where the judge might find that "punishment enough."

You guys are all missing the point that #1 He was't drunk. #2 He didn't commit cold blooded murder. It was a friggin traffic accident.
Now I am not saying that he shouldn't be punished, I think 100 days in county jail added in the guilt he must feel is a lot of punishment, don't you think ? It's a life time of knowing you took someone's life and you lost everything except your life.. but certainly the life as he knew it is gone.
Also, almost all of us speed. If you've ever lived in a sparsely traveled area or rural roads sometimes you might actually (gasp) speed. He should of know better, he did and he chose to do it anyhow. Most of us speed.
In all fairness, he should of been more attentive and I am sure Janklo had a sense about himself and his driving habits that he'd never cause an accident or take a life. His ego probably got in the way. What a waste huh. He was reckless and he will pay for it.
Just please put this into perspective. I feel for the victim's family but it was an accident involving two vehicles. The victim was in the wrong place at the wrong time. It's a shame he was killed.
Let's seriously pray that Janklo learns from this and makes some good come from all the negative and pain. He couldn't do this in a jail cell. He needs to be out in public humiliated and feeling really guilty somehow making up his hit to society.
Worst case what if he did have a diabetic episode? He's still responsible for his actions and now his past actions come back to haunt him.
I'm done ranting.

A hundred days or years, it's not going to make things "right" or bring back the dead. Janklow was a polarizing public figure so no sentence will ever be enough for those that hate him.
It was an ACCIDENT unlike the comparison in sentences to someone who purposely killed a cat or such other nonsense.
Accidents happen, he'll be punished the rest of his life way beyond what's cruel and unusual, and we should all pray we never have to walk in his shoes.
