Should I fire him now and take the lesser candidates?

So out of all the American engineers who are out of work right now ... you couldn't find one as qualified as the H1B ... SURE

No, but the burden is on you to prove to the rest of us nobody in the country could fill this job and relocate to your area. A website should be provided for employers considering hiring an H1B and all citizens should have the right to look at these jobs and apply for them.

It's probably not you, but I've seen people abuse these programs. How can it be justified that there are people training their replacements, there's just no excuse for that.

I don't think we should eliminate the H1B visa program, but it needs greater oversight. I prefer this to the outright outsourcing of jobs, since these people offer many benefits to our country, and help us with the "brain drain" that keeps us on top.

I think an H1B has 10 days to leave the country if his employment has been terminated. Is your guy legal?
