There are probably a few cases of CP that are due to birth injuries. The vast majority though, occur in utero and are no fault whatsoever of the obstetrician.

Why do many communities find it nearly impossible to attract obstetricians and why are so many doctors leaving obstetrics?? Beause of these exact type of law suits. The sort that John Edwards got rich from. Which is ultimately placed on the back and comes out of the wallets of the working public like you and I of course.

Hopefully this will happen, brcause if Edwards wind the nomination a lot of this will be off limits.

No matter what the REAL TRUTH is, the media would eat Bush alive if he attacked Edwards on something that the media can prtray as "Edwards defending CHILDREN and the LITTLE MAN"

IOW, the Dems will have to eat thier own on this one, because a vast majority of Edwards Lawyer antics will be untouchable by a Republican.

I attended a continuing legal education seminar last month, and one of the topics was "toxic tort" cases. This kind of case involved some poor plaintiff who contracted cancer or some other serious disease suing the nearest factory that discharged chemicals into the environment. The lawyer (from one of Alabama's biggest personal injury firms) admitted that usually there was not a conclusive link between the illness and the substance in question, or even that the defendant factory was even the source of the harmful substance (after all, the every other factory upstream might discharge the same thing). They would bring in their "expert", who might be the only person in the world who can diagnose that a certain substance caused the illness in question, to make the connection. Basically, they were suing because big bad defendant corporation MIGHT have discharged something that MIGHT have made poor helpless plaintiff sick, all based on junk science.

Is there any significance to the question? One's career is built on flash and insincerity, and the other's is based on... flash and insincerity. Call them phony and phonier.

Eldon L. Boisseau of the Kansas-based firm Turner and Boisseau, specializing in defending doctors' insurance companies from medical malpractice lawsuits, agreed that physician-caused cerebral palsy "occurs only rarely."

What a surprise.

"At the end of the day, I verily believe we will find [the cause of cerebral palsy is] all genetic," Boisseau said in an interview with CNSNews.com .

This guy is as bad as Edwards. Cerebral palsy is caused by brain damage. This obviously can result from many things other than genetics.
