I think the original idea was to fill positions which became vacant during what used to be a very long recess between sessions, but Presidents of both parties have filled positions in this way in recent years. Clinton did it to put Bill Lann Lee in place because he couldn't get confirmed. The Democrats and their media supporters have no grounds for complaint.
