City to retract release calling Free Republic a 'hate group.'

Fresno will pay $60,000 to conservative online forum Free Republic and retract a news release that called the organization a "hate group," according to a settlement agreement released Monday. Free Republic founder Jim Robinson, who lives in Fresno, said he wouldn't have filed the suit if the city had acknowledged its error.

"I think it's unfortunate the city did not retract and apologize immediately after they knew they were in the wrong," Robinson said.

City Attorney Hilda Cantu Montoy said the lawsuit was settled to "avoid the expense and burden of litigation."

"It's not in any way admitting any liability by any party," Montoy said.

That's kind of you to say. Another poster mentioned that there is some sort of automatic mechanism that prevents full posting of articles from verboten sources, but I felt that discretion and what my grandmother used to call "chicken checkin'" was the better part of valor.

The irony in this matter is within those liberal, "Can't we all just get along" words -- and Fresno is still paying (... how much? ...) for a salaried "Human Relations commission" staff with full benefits and office space?

I learned in law school that the common law tradition is that you can't libel or slander a group of more than 20 people, and the article said that there are 50 or more members in the Fresno area. Is the law of defamation different in California?
