NY Judge says most women enjoy being abused and ask to get “smacked around”: Resigns

The New York State Commission on Judicial Conduct has completed formal proceedings against Robert Hamley, a former justice of the Hunter Village Court, Greene County. Pursuant to a stipulation, which the Commission approved on December 11, 2003, the proceedings were discontinued and the case was closed.
Under the terms of the stipulation, Judge Hamley waived the statutory provision of confidentiality applicable to Commission proceedings, to the limited extent that the stipulation would be made public. The stipulation indicates the following:

The Commission served a Formal Written Complaint on Judge Hamley dated July 17, 2003, containing two charges; |

One Charge alleged that Judge Hamley made improper statements about the victims of domestic violence, including telling one alleged victim that all domestic violence cases are a waste of the courts time and telling a trooper that most women enjoy being abused and ask to get smacked around; |
 |
The other Charge alleged that Judge Hamley took jurisdiction of two traffic charges that were pending before another court, engaged in prohibited ex parte communications with the defendant and the mayor of Hunter about the cases, and improperly disposed of the cases; |
 |
A hearing in the matter was scheduled to commence on November 18, 2003, before a referee, Joseph A. Barrette, Esq.; |
 |
Judge Hamley acknowledged that he could not successfully defend the charges against him; and |
 |
Judge Hamley resigned on November 17, 2003, effective immediately, and agreed that he would neither seek nor accept judicial office at any time in the future. |

Well, I wonder if, had she been alive, he would've said this to a client of ours. She was stabbed 14 times by her husband in their front yard. She probably asked for it, right?

I believe the judge was influenced by his observation of not-infrequent cases in which the female victim asks that her assailant not be arrested or refuses to sign a complaint against him if he is arrested, sometimes after repeated assaults. The judge did choose the wrong words to characterize such women who do not like their abuse but are psychologically unable to take the steps necessary to extricate themselves from the situation.

There are many judges who never should rise above dog catcher.
I was once in traffic court to have a speeding ticket reduced and was asked by the judge when was the last time I received a moving violation. My answer was seventeen years and he told me that he didn't believe me and only reduced the fine a small amount. He did the same for the man after me, who like me was new to the area. Then a local came up and he asked how long they had lived in the area, reduced the fine by half and stated that, we locals have to stick together.

And there is the case of the controlling woman whose favorite game is prodding and provoking the weak husband to some kind of action, even if it be violence. Have you seen that?
