This is a Hospice Patients Alliance Special Update Jan 5, 2004, sent out periodically to inform the public about news affecting hospice and end-of-life care.
We have just confirmed that ALL of Judge Baird's cases, INCLUDING the suit by Michael Schiavo v Gov Bush related to the Terri's Law, challenging its constitutionality, HAVE been transferred to Judge Nelly Khouzam. This information came directly from Judge Khouzam's assistant. Judge Khouzam is known to be a "by the book" tough, but fair judge.

The court is NOT explaining why the judges were suddenly switched, except to say that "judges rotate from time to time." We believe it might have something to do with:
Local PINELLAS COUNTY COURT BAILIFFS AND COURT EMPLOYEES WERE TAKING BETS ON WHETHER TERRI WOULD DIE OR NOT!!!
It was widely reported that Judge Baird made reckless and prejudicial comments in support of Greer and Felos and against Jeb's lawyers way before he had heard the evidence from the Governor's attorneys.
In other words, Judge Baird's comments are the likely reason local Pinellas County employees were doing "inside betting" that the local Pinellas County Judges would back each other's poor and constitutionally illegal decisions against Terri's constitutional rights and thus overrule Jeb Bush and Terri's Law. The 6th Circuit Judges are upset to have anyone tell them they are morally and legally wrong...... whether it's constitutionally illegal or not to murder Terri.
Conducting inside betting on the case is a severe violation of the code of conduct for court employees! Whether that is, or is not, the reason the judges have been switched, the very important change in judge can be extremely significant to what happens to Terri. We are hoping that Judge Khouzam will give the Gov a fair hearing in the case and allow the discovery he sought (which was denied by Baird). If Judge Khouzam allows some discovery as requested by Gov Bush, it could make all the difference!

The woman thing has some meaning because this woman would be the first woman to preside in Terri's case. The men in this matter are not "her peers" in any way whatsover. It looks like GENDER BIAS that "all these men want to kill her". I said so on the radio but only once. I was censored thereafter. FELOS must have called wfla radio immediately after I was on the radio because they took it off. I also said "Terri understood jokes." WELL, THAT COULDN'T BE ON ALL EVENING LONG! So, I was on during drive time at least.

Who ever said they weren't available for depositions?? Who has subpoenaed them for deposition and in what cause before the Court?? What Court??
If you are intimating that you want to depose them to somehow undue the findings and opinion of the Court, good luck. That is now res judicata. Too late.....

Well, that's what happened in October, 2003. I didn't say they were accepted but they were filed in the 1st DCA and another DCA in addition to the 2nd. Did you follow the amicus filings at all?

Why can't the HINO just walk away and leave Terri to her family? What is the big deal, if she is truly vegetative and knows nothing of what goes on around her? (which I don't believe for a second)
Any NORMAL person would have let go a long, long time ago. But, MS and Felos are anything but 'normal.'

You're looking for spooks. The officer may have been requested by the Hospice to be there- very likely. Further, it is not unusual for officers involved in this sort of detail to be doing so on their "own time" and do work at the direction of the person or organization who hired them.
I'm sure that if someone were to attempt to pass anything to Terri by mouth and the Hospic's person in charge had told the officer not to allow it(and she was NPO after all) they would be negligent if they did not stop them.
As to the lip gloss business, I have never found anyone outside of Terri supporters that substantiates this story. Maybe it happened, maybe it did not. If it did and there was no medical consideration, I find the incident abhorrent.

You know the Judge Greer wouldn't allow Pat Anderson to take depositions. You are playing with words, that's all. In fact, if you really know about this, you'd know that the deposition issue was a hot potato with another Judge who threw it back to Greer.
One thing is clear THE SIXTH CIRCUIT IS INCONSISTENT AND UNRELIABLE, unless it's a suicide on stage. We can't have that in Pinellas County but it's okay for Terri to be starved to death.
Judge Lenderman did an INJUNCTION. Jeb Bush signed an Executive Order. Both actions saved a life.
Your question marks are telling. Answer a question with a question. Just a technique you're trying today.

If this becomes a criminal investigation, there will be no 'undoing' - it will be a new case. Florida vs. Michael Schiavo, for example. Time to get Mikie a criminal defense atty, bye-bye goat boy. :)

Yes, you can file for permission to intervene as an amicus, however it must in this case, be filed in the Sixth DCA. You cannot file in the Second, Third, First, etc. as they are without jurisdiction. The venue of the underlying case determines which Appellate Court will hear any allowed procedure, be it an appeal, a writ etc.
As to Pat Anderson, ahhhh, there- if there is one- is the rub. She's really not a very skilled attorney in my opinion.

We must call it by the PC name - the spousal murder privacy privilege, designed by Felos and put into effect by Greer. What a team! Maybe they could market their services to rich millionaires and heiresses on their 3rd, 4th, 5th and 6th marriages.

Was it an attempt to re-hear or did it have to do with the Constitutionality of Terri's Law?

Thanks, cyn. I'm having a spongebob birthday party this weekend. Cheesecake with the pre-fab sugar replicas of spongebob & the gang placed on top.
Further, I'll be taking pictures at the protest(s) tomorrow and Thursday. I'll post them after I shrink them for my web site. They won't be so gigantic that way.
