Faced with a not-so-novel groundwater pollution problem, the city of Lodi in San Joaquin County came up with a novel strategy: Assume authority from the state and federal governments for the clean-up, and then pass a local law that forces the polluters (or their insurance companies) to pay whatever legal costs the city might run up during the process of prosecuting the case.

Perfect solution - tell the lawyers, who well knew the activity for which they billed was on dubious grounds in both legal and ethics perspectives, that they can go screw themselves. And throw out the politicians who made such an odious deal.

We have a similar situation here in Humboldt County when the new DA suing Pacific Lumber two weeks after being sworn in. The Board of Supervisors nixed his request for funding and citizens qualified a recall against him. The election is in March. He has heavy funding from the greens...
