Even Saddam Hussein has legal options.

The deposed Iraqi leader could harken back to the trials of Nazi leaders and Japanese commanders after World War II to fight expected charges of genocide and war crimes, claiming he never personally killed anyone or that he had no control over atrocities committed in his name, U.S. defense lawyers and scholars say.

Trial or no trial, Saddam is the walking dead. There is no place on this planet where he would be able to relax and not be looking over his shoulder. Turning him loose would be the worst possible sentence he could face.

I'm sure that the Iraqis will handle him 'correctly'. "How would you like your Saddam today?" Shredded. Slowly.
