Does it worry you in the least that the prosecutors didn't have even one provable fact of Rush breaking the law before they decided they needed to see Rush's med records?

They had Rush's admission that he was addicted, and when you are, there are various ways of getting the drugs, and one of them is doctor shopping. Then they checked out the pharmacies and found several overlapping prescriptions for a large period of time. There are two explanations for that, one of which is shady physicians, and the other is doctor shopping. That is probable cause to see his medical records will show which one is true. But Rush doesn't want them released. I wonder why?

And in the vast majority of the cases a first time non-violent, non-trafficking addict who admits his/her addiction and seeks treatment gets probation. Should Rush get different treatment, such as this fishing expedition?
