The idiot justices ruled that the Congress' authorization to seek out and destroy Al Qaeda did not include the right to detain al Qaeda. Evidently you are not one of the three or four on the thread who understand the ruling. But then again, it's tough to understand when you haven't read it so I can empathise a bit.

instead it bizarrely pretended that miltary force does not include military detention.Authorising multary force by Congress certainly does not allow the US military or it's assigns to round up American citizens.
The court was correct in it's ruling.

Well, it seems you do, if you enter intoe the armed forces o0f a foreign state agains the United States.
Padilla didn't do that, so, I guess he's still a citizen, to our collective shame.
But, he should still be held as a military detainee.

Either they have the evidence to charge him or they don't. If they do quit playing games and charge him. If they don't have the goods to charge him and take to trial then his arrest and detention is a fraud.
The Judges made the right decision. Your cannot selectively apply the Constitution to only those defendants you like.
