Rehnquist, O'Connor and Ginsburg It would seem improbable, politically. It would make the court even more of a political issue than usual in a presidential election. I wouldn't be an issue but the issue. 3 justices, including O'Connor and a Republican and a Democrat, would be "all the marbles" for whoever won the election--and therefore the Democrats would continue to fillibuster any nomination in hopes of making lightning strike in November. It would be ugly. And what is to come of the Senate, if the Democrats were able to win the presidency and nominal control of the Senate? Will an appellate judge ever be confirmed again??
