According to a recent Quinnipic poll, Hillary and Bush would tie 47-47 in New York if she were to run. How many states are as liberal or more liberal than NY? Massachusetts, NJ, CA, IL, HI, RI? How many electoral votes does that get her - about 125? Where else is she going to win?

You know, I do hope you are right. However, in 1992 I believed no one would be foolish enough to vote for Bill Clinton. In 2000, I thought that surely no one would think Hillary Clinton could be a good senator.

In both cases I was wrong. I would rather be overly concerned than be caught flat-footed.

Sure, I understand the concern and the strategy. Always put forth effort as though you're behind. To be honest I'd love to see her run in 2004. Bush & Co. will bury the Clinton legacy once and for all. And beyond her the Democrats have absolutely no legitimate contenders on the horizon (and as I've said I don't even believe she's a "contendah").

but for some reason there are a bunch of people on this site who practically attribute superhuman powers to her.

The woman is a gutless manipulator who hangs in the shadows only to emerge when others have paved her way and lessened the risk. How else can you explain her marriage? And how can you dismiss this personality from employing the same formula with the current field of Democrats?

Secondly, Hillary is the one Dem who can capture the Dean base of anger and Bush-hate. But as we saw today, she can reach out further than that base, assuming a more moderate tone. Here again, she can use Dean's work in consolidating that base and capitalize on the failure of any other Dem to capture a significant percentage of support.

It seems only reasonable to me that Hillary is the one Dem who can hold Dean's base while merging the paltry national numbers of Lieberman, Kerry, Gephardt and Edwards.

"I'm a star witness against President and Mrs. Clinton," Aaron Tonken said in court documents made public earlier this year.

"I'm a star witness in New York in the grand jury regarding the Marc Rich pardon and regarding the fundraising activities that I've done on behalf of the Clintons," the celebrity moneyman continued.

"It's multi-faceted. Part of it's a criminal investigation dealing with the former president; part of it's a massive investigation with the IRS with me in conjunction with all celebrities that I've gifted."


Prosecutors with the U.S. attorney's office in New York are said to have new evidence that Mrs. Rich violated an immunity arrangement by hiding certain relevant details of her story, the New York Daily News reported on Friday.

WNBC-TV in New York reported Friday that the new trouble for Rich began after Tonken was called to the city in August to detail for investigators what he knew about the money she gave to the Clintons, and Mr. Clinton's subsequent pardon of Rich's ex-husband, fugitive tax fraud convict Marc Rich.

The exact nature of Tonken's allegations against the Clintons remains unknown. But the celebrity moneyman is known to have been involved in a controversial August 2000 fund raiser for Hillary Clinton staged by Hollywood mogul Peter Paul.

According to a report in the August issue of Vanity Fair, Tonken first broached the idea of using a series of star-studded galas to bankroll Mrs. Clinton's 2000 Senate campaign, and personally outlined the plan to then-President Clinton himself at a 1998 party thrown by Mrs. Rich.

Mr. Paul has told Judicial Watch, which is representing him in the case, that his costs for producing the August 2000 gala amounted to a $2 million contribution to Clinton's Senate campaign – money that went unreported to the Federal Election Commission, as required by law.

Paul has recently been retrieved from a Brazilian jail by the Justice Department and is said to be cooperating with prosecutors in New York.

Acampaign fund run by then-candidate Hillary Clinton failed to report nearly $2 million in in-kind contributions from a Hollywood fund-raising event coinciding with the 2000 Democratic National Convention, alleges a lawsuit filed in Los Angeles County.

Peter F. Paul, co-founder of the online company Stan Lee Media Inc., claims then-President Bill Clinton agreed to work for him after leaving office. To seal the deal, Paul says he made $1.9 million in campaign contributions, most going to a star-studded tribute to the president.

An attorney general's lawsuit alleges the $1.7 million was diverted by Hollywood fund-raiser Aaron Tonken and associates. Tonken, who once worked for Paul, is now a defendant in Paul's Clinton lawsuit.

Tonken organized the celebrity-heavy Clinton event that Paul says he underwrote with $2 million as part of a hazy $15 million deal to employ the president after he left office.

Paul wanted Clinton to promote Stan Lee Media. Host of the event was Stan Lee, creator of the Spider-Man, X-Men and Incredible Hulk Marvel Comics characters, whom Paul hoped to turn into a universally recognized figure like Walt Disney.

The company subsequently collapsed in the dot-com meltdown; two of Paul's associates were sentenced in August for their role in a scheme to manipulate the company's stock prices. Paul says he borrowed against the company's stock margin account in part to pay for the Clinton tribute.

Paul and his wife co-hosted the event, with honorary hosts Gov. Gray Davis and his wife, Sharon. It raised more than $1 million toward Hillary Clinton's Senate bid.

Paul's suit alleges Tonken approached him in December 1999 about contributing to a Feb. 17, 2000, Democratic National Committee fund-raiser hosted by Davis at the Cafe Des Artistes in Hollywood.

During the event, he says he broached the idea of hiring Clinton to Tonken and another Democratic fund-raiser, and to Edward G. Rendell, then chairman of Democratic National Committee and now governor of Pennsylvania. He alleges all three urged him to contribute more money to increase his chances of employing Clinton after he left office.

He says he agreed to Rendell's request to donate $150,000 in Stan Lee Media Inc. stock to a June 2000 fund-raiser supporting the presidential campaign of then-Vice President Al Gore, and another $150,000 in stock to co-host a fund-raiser for Clinton's Senate campaign a day later. Rendell's press secretary, Kate Philips, said the governor won't comment.

Paul says further conversations with Clinton intermediaries persuaded him to underwrite the August 2000 Hollywood tribute. The in-kind contributions were never properly reported, he contends, after The Washington Post days later reported that Paul had served three years in prison in the 1970s.

Paul additionally alleges he was convinced by a Clinton fund-raiser to contribute $55,000 in Stan Lee Media stock to a New York political party to benefit her Senate campaign. Documents appear to show the transaction even as the Clinton campaign was disavowing Paul's contributions, but Dan Cantor, executive director of the Working Families Party, said no such contribution is reflected in the party's records.

Paul also alleges Clinton's Senate campaign illegally accepted a $27,000 contribution from one of his business partners, a Japanese citizen who attended the Hollywood event and also wanted to eventually employ Clinton.

He also is suing a controversial joint fund-raising committee, New York Senate 2000, set up by Clinton's campaign and the Democratic Senatorial Campaign Committee as a legal means to collect hard and soft campaign contributions far in excess of the usual federal limits.

DSCC spokesman Brad Woodhouse said he couldn't comment. FEC spokesman George Smaragdis said the disclosure requirements were the same for joint committees as for any other committee or candidate

a Los Angeles judge granted a preliminary injunction that prevents Tonken from soliciting any more money for charity. Tonken has been sued by California state Attorney General Bill Lockyer for allegedly bilking a half-dozen charities supported by the Clintons and prominent Hollywood celebrities. Tonken also faces a federal criminal charge of mail fraud.

Here's the lowdown on Hillary's Hollywood flimflam man that you won't find in her new best-selling book:

Tonken is a former street bum with a creepy lifelong attraction to Hollywood stars and powerbrokers. He once cold-called Jackie Onassis and sweet-talked Zsa Zsa Gabor into allowing him to stay at her apartment. He crashed the celebrity fund-raising scene a decade ago and quickly rose to the top. Tonken hooked up with Democratic socialite Denise Rich -- ex-wife of fugitive financier and Clinton pardonee Marc Rich -- for a lavish charity event in Milton Berle's honor five years ago; it was reportedly Mrs. Rich who introduced Tonken to the Clintons.

Tonken's mentor was Peter Paul, a convicted felon who was seeking access to the Clintons on behalf of his business partner Stan Lee (comic-book creator of Spider-Man). Paul claims to have underwritten a Hollywood gala for the Clintons produced by Tonken in August 2000. The liberal elite bash -- attended by Cher, Melissa Etheridge, Ted Danson, Michael Douglas, Whoopi Goldberg, Goldie Hawn, Shirley MacLaine and John Travolta -- was both a tribute to the former president and a soft money fundraiser for Hillary's New York Senate campaign.

Paul, who partied hard with Bill, Hill and Chelsea at the star-studded event, alleges that his direct and in-kind contributions worth $2 million were disguised in order to hide his involvement with Hillary's campaign. He also claims that Democrat officials solicited a contribution from Paul in return for a presidential pardon he unsuccessfully sought for his two prior convictions for cocaine possession and fraud. Paul has since fled to Brazil. He is fighting extradition to the U.S., where he faces an indictment for his role in a $25 million stock manipulation scam involving Stan Lee's media company.

Meanwhile, Tonken faces a lawsuit by California Attorney General Lockyer alleging that he defrauded charities and their donors, diverted donations to bank accounts he controlled and refused to account for more than $1.5 million in contributions to six charitable events he agreed to produce. The defrauded charitable organizations include the Kids Campaign, the Joan English Fund for Women's Cancer Research, the Michael J. Fox Foundation, the Betty Ford Center and Inner-City Games Foundation.

The ripped off charities include organizations supported by celebrities such as singer Rod Stewart, the pop music group *Nsync and the cast of the TV show "Ally McBeal."

According to an FBI affidavit relating to the federal mail fraud charge against Tonken: "Tonken routinely made misrepresentations which defrauded the underwriters and donors for these events. To cause donors to contribute to the events, Tonken regularly overstated the amount of underwriting funds that had been raised, understated the cost of producing the event, and promised that celebrities had agreed to appear at the events when they had not."

(Given his connections to two fugitive FOTCs (Friends of the Clintons), one questions the wisdom of allowing Tonken to remain free on a $50,000 unsecured bond.)

How could the brilliant, ethical, do-gooder Hillary get herself entangled with such a creep? The same way so many other lowlife FOTCs came into their lives. Cha-ching. "Through Peter Paul's money, I bought entre to President and Mrs. Clinton," Tonken recently bragged. Whether she was stupidly conned or complicitly cunning, her involvement with Tonken and Paul stinks to high heaven.

I just heard that Dean's response to his sealed records (letting a judge decide) was in response to Judicial Watch's lawsuit filed LAST WEEK. In my opinion, the lawsuit has given Dean cover for keeping his records sealed, by "letting the judge decide." Klayman once again, either through ignorance or malevolence, plays into the enemy's hands.

Dear Sir/Madam:



I. INTRODUCTION.



Judicial Watch, Inc., (hereinafter “Judicial Watch”) is a non-profit, public interest law firm that investigates and prosecutes government abuse and corruption. Judicial Watch client, Mr. Peter F. Paul, in the public interest, and based upon his personal knowledge, complains to the Federal Election Commission, in accordance with 11 C.F.R. §111.4 and 2 U.S.C. §437 (g)(a)(1), against: Senator Hillary Rodham Clinton, Hillary Rodham Clinton for U.S. Senate Committee, Inc., New York Senate 2000 Committee, David Rosen, Edward Rendell, Stephanie Berger, James Levin and William Jefferson Clinton. Specifically, the aforementioned individuals and organizations appear to be in violation of:

1. 2 U.S.C. §431, et seq. (Definitions).



2. 2 U.S.C. §434(b) (Reporting Requirements).

3. 11 C.F.R. §104.3 (Contents of Reports).

4. 11 C.F.R. §110.9(a) (Violation of Limitations)

5. 11 C.F.R. §110.9(b) (Fraudulent Misrepresentation)



II. FACTS.



A. Background Concerning Peter F. Paul And Stan Lee Media, Inc.



Peter F. Paul of Calabasas, California, is an acclaimed Hollywood executive with extensive experience in event production, entertainment marketing, and media positioning. In 1999, he co-founded Stan Lee Media, Inc.(“SLM”), a branded global entertainment company. By early 2000, SLM was publicly traded on the NASDAQ stock exchange and enjoyed a market capitalization of approximately $350 million. In order to further increase the business prospects of SLM, Mr. Paul sought to build his business partner, Mr. Stan Lee, whom he considered to be the “Walt Disney of the comics industry,” into a major cultural and branded entertainment figure. Mr. Paul believed that one way to achieve this goal was through politics.



Mr. Paul contributed approximately $1.9 million dollars in cash and “in-kind” contributions to Hillary Rodham Clinton for her federal election campaign for the United States Senate. Mr. Paul’s contributions to Hillary Rodham Clinton were specifically for the purpose of influencing the outcome of a federal election.





B. Mr. Paul Is Approached By Hillary Rodham Clinton’s Agents.





In early 2000, Mr. Paul was approached by a former protege, Aaron Tonken, about elevating Stan Lee’s public profile, recognition and acceptance by contributing money to the Democratic Party. After being introduced to the President and Mrs. Clinton and Vice President and Mrs. Gore by Denise Rich at a small reception held at Mrs. Rich’s home in October 1999, Tonken had become a trusted producer for the Democratic National Committee (“DNC”), providing support and widely-recognized Hollywood talent for DNC fundraising activities with President Clinton and other prominent Democratic Party politicians. Tonken had worked directly with DNC Chairman Edward Rendell and DNC Southern California Finance Chairwoman Stephanie Berger on these fundraising activities.



Tonken induced Mr. Paul to contribute $30,000 to the DNC to co-host a fundraiser attended by President Clinton at Café Des Artistes in Hollywood, California. The dinner, held on February 17, 2000, was chaired by California Governor Gray Davis. In addition to Mr. Paul, other co-hosts included entertainer “Babyface” Edwards, actress Calista Flockhart and two real estate developers.



Mr. Paul was led to reasonably believe by Tonken, Rendell and Berger that his substantial contribution to the DNC would enable Mr. Paul to better position himself to enlist the President’s support for recognizing Stan Lee’s significant contributions to literacy and global popular culture, including a Kennedy Center Honor and a White House presentation of a Presidential Medal of Freedom.



Mr. Paul, who admittedly had no experience or direct knowledge about major campaign contributions or federal campaign finance regulations, was prepared to commit a significant portion of his family share holdings in SLM, then valued at approximately $60 million, in order to achieve his strategy of elevating Stan Lee’s public profile, recognition and acceptance through the good offices of The White House, and was thereby induced to become a major contributor.



Mr. Paul was seated with President Clinton at the Café Des Artistes event. Mr. Paul also was introduced to Governor Davis, DNC Chairman Edward G. Rendell and California DNC Finance Chairwoman Stephanie Berger.



During the Café Des Artistes event, Mr. Paul, Rendell, Berger and others began discussions about Mr. Paul providing more substantial support for the Democrats. In particular, Rendell and Berger suggested that Mr. Paul and Stan Lee co-host a DNC fundraiser to support Vice President Al Gore’s presidential campaign. Rendell and Berger also suggested that Mr. Paul and Stan Lee co-host a DNC fundraiser at Mr. Paul’s home in Los Angeles, California to be attended by President Clinton.





California DNC Finance Chairwoman Stephanie Berger and David Rosen, the Director of Finance for Mrs. Clinton’s Senate campaign, asked Mr. Paul to make a $150,000 commitment to co-host a luncheon for Mrs. Clinton at Spago in Beverly Hills on June 9, 2000. Mr. Paul agreed to support Mrs. Clinton’s U.S. Senate campaign, however, by making a $150,000 commitment to co-host the June 9, 2000 luncheon and tea with Stan Lee. At about the same time, Mr. Paul became acquainted, through David Rosen, with Jim Levin, a friend and fundraiser for President and Mrs. Clinton from the Chicago area.





C. Mr. Paul’s Contributions To Hillary Rodham Clinton’s Election To The Senate



Over the following month, Mr. Paul became increasingly involved with DNC operatives and members of Mrs. Clinton’s campaign staff concerning fundraising for Mrs. Clinton’s election to the U.S. Senate. On July 11, 2000, Mr. Paul participated in a conference call with Rosen and other fundraisers for Mrs. Clinton to discuss Mr Paul’s and Stan Lee’s sponsoring a fundraiser for Mrs. Clinton just prior to the Democratic National Convention in Los Angeles, California. Mr. Paul suggested a Hollywood Tribute to the President, the proceeds of which would be used to elect Mrs. Clinton to the U.S. Senate. The event was to be held on the grounds of the home of radio magnate Ken Roberts, in Brentwood, California.



Mr. Paul agreed to finance the Hollywood Tribute fundraiser. Any additional funds raised from persons attending the fundraiser would constitute net contributions to Mrs. Clinton’s U.S. Senate campaign. In agreeing to finance the event, Mr. Paul intended to influence the outcome of Mrs. Clinton’s U.S. Senate campaign, not any other election campaign. At no point did Mr. Paul ever intend to influence the outcome of any other election or to benefit any candidate other that Mrs. Clinton. The President and Mrs. Clinton knew this to be the case.



As the Hollywood Tribute fundraiser drew closer, Mr. Paul became concerned about the increasing cost of the event, which was exceeding $1 million. Mr. Paul complained to Rosen, Levin and others repeatedly about the cost. Rosen told Mr. Paul not to discuss the mounting costs of the fundraiser because, for public relations purposes, Mrs. Clinton’s U.S. Senate campaign did not want the true cost of the fundraiser to become known. Rosen also told Mr. Paul that certain fundraising ratios required by federal campaign finance laws would be skewed if the true cost of the fundraiser became known.



At all times, President Clinton, Mrs. Clinton, Levin, Rosen and many others knew that Mr. Paul, not SLM, Stan Lee, or anyone else, was paying for the Hollywood Tribute fundraiser. Mr. Paul repeatedly told Rosen that this was the case, as did SLM Chief Executive Officer and President Ken Williams. SLM General Counsel Ric Madden also told Rosen that SLM could not and would not incur any costs for the fundraiser. Rosen also witnessed Mr. Paul writing checks for costs associated with the fundraiser.



The Hollywood Tribute fundraiser for Mrs. Clinton’s U.S. Senate campaign proceeded as planned on August 12, 2000.



On August 14, 2000, Mrs. Clinton called Mr. Paul at home to thank him for paying for the Hollywood Tribute fundraiser. In fact, the President and Mrs. Clinton had made several calls to Mr. Paul to encourage his support and to thank him for the event.



On August 18, 2000, both President Clinton and Mrs. Clinton wrote thank you notes to Mr. Paul for the Hollywood Tribute fundraiser. President Clinton expressly thanked Mr. Paul for “the boost it gave to Hillary’s campaign.” See Exhibit 1.



Mr. Paul conceived, designed, organized, produced, conducted and paid for the August 12, 2000 Hillary Rodham Clinton fundraising event entitled “A Hollywood Tribute to President William Jefferson Clinton.” Mr. Paul personally financed the entire event. In total, Mr. Paul spent approximately $1.9 million of his own personal funds for the Hollywood Tribute fundraiser.





D. False Reporting Of Mr. Peter F. Paul’s Contributions To Hillary Rodham Clinton’s Election To The U.S. Senate



Attached as Exhibit 2 are the Year 2000 reported political campaign contributions of Peter F. Paul as reported to the Federal Election Commission and made publically available on the Internet.





FEC records indicate Mr. Paul’s federal election contributions for year 2000 total only $2000.00.



Mr. Paul’s contributions, both cash and “in-kind,” have been improperly and/or inaccurately reported by Mrs. Clinton and her federal election campaign committees. There is clear and compelling evidence that Mrs. Clinton and her staff have failed to report “in kind” contributions, as well as the allocation of contributions in accordance with federal election law.



Attached as Exhibit 3 are Mr. Paul’s checks and statements, detailing and documenting the itemized expenditures Mr. Paul made to Mrs. Clinton’s election.



In light of the above, Mr. Paul has demanded that Mrs. Clinton return the contributions Mr. Paul has made to her. A copy of this demand letter is attached as Exhibit 5.



III. CONCLUSION.



Mr. Peter F. Paul made cash and in-kind contributions to the federal election campaign of Hillary Rodham Clinton for the U.S. Senate seat representing the State of New York, totaling almost $2 million dollars. Mr. Paul intended his contributions to Hillary Rodham Clinton to influence the outcome of a federal election, in favor of Hillary Rodham Clinton’s election.



Federal Election Commission records for year 2000 reported political contributions by Peter F. Paul reflect a total contribution of $2000.00.



The Federal Election Commission is obligated to investigate false and misleading reporting by Senator Hillary Rodham Clinton, her campaign and related committees concerning Mr. Paul’s contributions.
