Bombshell: Kobe Accuser Had Sex with Key Witness

A new bombshell revelation in the Kobe Bryant case threatens to destroy the credibility of the prosecutions key witness - whose testimony could send the basketball superstar to jail for years. Sources told GLOBE that the 19-year-old woman who has accused Bryant of rape told them she had sex with the prosecutions star witness Bobby Pietrack - a week before she met Bryant.
Pietrack, a 23-year-old bellhop at the resort where the alleged rape took place, is the first person Katelyn Faber told about her encounter with Bryant. He can testify about her emotional state and physical appearance at the time.
But legal experts tell us that if there was a sexual encounter between Katelyn and the bellhop, it could wreck his credibility and sink the case of the Eagle County, Colo., prosecutor.

No sperm in the underwear. The sperm and semen is on swabs that have not been tested.
I think there will be expert testimony to state the circumstances when sperm is present and so on and that the swab evidence would have to be deposited within a certain window. Am waiting on the underwear explanation to be forthcoming. Also, will the vaginal swabs be from Bryant, match the underwear person, or be from someone else.
Questions, questions. I, like you, just like to trial watch.

I advocate for the facts and the truth to come out at trial and I am accused of being a Rah Rah boy for Kobe (I hate the Lakers and everything they stand for-- Go Kings!) and giving aid and comfort to rapists everywhere.
The purpose of rape-shield laws is to prevent rapists everywhere from going on fishing expeditions through their victims' private lives. If you advocate dropping rape-shield laws, the very real consequence is that you are enabling rapists. What is wrong with these people that want to strip a man of his right to a defense against the type of charge that any one of us could be falsely accused of?
This is a nonsense premise. It's patently false that "any one of us could be falsely accused of" rape. Avoid casual sex, avoid adultery, and don't put yourself in positions where you're alone with women you don't know, and your odds of running into Potiphar's wife or her modern counterparts, will diminish to nearly zero. I have personally seen a boatload of false sexual harrassment claims in my practice.
Apples and oranges. The adjudication process is usually different, and the standard of proof is much lower. We don't even have a widely held definition of what sexual harassment is. We do understand what rape is. Either way, the solution is simple: make the penalty for the premeditated filing of a false charge, in all crimes, equivalent to whatever it would have been if the accused had been guilty. Obviously, aquittal of the initial defendent would not mean the initial accusation was deliberately false; a second trial would be required. That's a better solution to preventing false rape accustations, rather than arming rapists with the ability to humiliate their victim under the color of the authority of the courts.

You use a biblical example of a guy (Joseph) who was as clean as a whistle who refused to put himself into any compromising positions who was falsely accused of rape and falsely imprisoned for it and then you claim that it could never happen to anyone if only we'd all act like Joseph. Your failure to see the fallacy of your argument is laughable. Maybe you should hit the abuse button on yourself and get your post deleted so you don't look so silly.

That you've seperated cause and effect does not demonstrate an inconsistency, any more than saying "day follows night." It's completely up to the indiviual to keep himself out of situations where he might be falsely accused of rape. It's actually not a difficult precaution to take. Quite the contrary. I never suggested that acting like Joseph would keep us from a false accusation of rape. The implicit cautionary note is not to put oneself in the position that Joseph did. The Bible is full of cautionary notes like that, even about the many protagonists. False accustions of rape and sexual assault and sexual harrassment can happen to any of us Sabertooth. Including you.
Therefore, the solution to such a constant worry is to minimize risk in the ways I've suggested, not to empower real rapists to smear their victims. Let's see... in a cost benefit analysis, is exhibiting self-control worth denying rapists a legal bludgeon over their victims? I think so. You, apparently, think not. If a woman I care about is mentally unstable, suicidal, sleeps around, and frequents men's hotel rooms, I would have a tough time believing that on one of those encounters where she set the whole thing up ( stayed late, arranged the tour, snuck back to the hotel room,etc) that she was raped rather than it be a sexual encounter. Sorry, it's just common sense.
If a woman I care about does not sleep around, is a pretty stable person, has stable relationships, I will be more likely to believe her when she says she was raped.
What if a male friend of yours was accused of rape and the accuser had a history like this one. Woudn't you think that's relevant? I do.
Or, if you don't think so, maybe you think Tucker Carlson and John Fund should be doing time for the rapes they were accused of. I'm sure they would love to have a juror with such a closed mind as yours that would ignore the mental stability of the supposed victim and prevent that evidence from seeing trial.
You blew it with the Potiphar example. Joseph did everything he could to avoid a compromising situation, exactly what you're advocating and somehow you still see fit to learn from his lesson as if he did something wrong.
Finally, if even a feminist, liberal, attorney like Susan Estrich, who is also a rape victim, exactly the person you would think would support a case like this can see that this whole case is a 'trainwreck', and questions how the rape shield laws are applied, you may want to think twice about this ridiculously stance you're taking on this that ignores any and every new evidence that comes out.

But those that have already decided he's innocent do themselves no favors by constantly tweaking the facts in an effort to paint her in as bad a light as possible.
I think it best to stick to fact, not fiction, when discerning what the truth is.

It's been my experience that the "attacks" have been both ways.
What do you mean by "free"?
IMO...they both have exhibited extremely reckless behaviour. And it sheds light into their character....And no matter what the outcome......the impact of what did...or didn't happen will forever be with them.
Fwiw, I wouldn't be surprised to find out...that the young lady is lying. And also I wouldn't be surprised to find out Mr. Bryant did indeed rape her.
