Governor Seeks New Trial Over Brain Damaged Woman's Wishes

Gov. Jeb Bush fired a volley of legal shots Wednesday at the husband of a brain damaged woman who is at the center of a right to die case, saying there needs to be a jury trial on whether Terri Schiavo wanted to be kept alive artificially. The governor also sought to remove Pinellas Circuit Court Judge W. Douglas Baird from hearing the constitutionality of the new law enacted to keep Terri Schiavo alive after her feeding tube was removed last month. In yet a third legal filing, the governor argues that Terri Schiavo's rights under the Florida Constitution are being protected, not violated.

Terri Schiavo went for six days without food and water after her husband Michael Schiavo removed her feeding tube. Florida lawmakers and Bush intervened, enacting a hastily drawn law that allowed the governor to order the feeding tube be reinserted.

Michael Schiavo has challenging the constitutionality of the governor's action. He contends his wife had said she did not want to be kept alive artificially before she suffered severe brain damage in 1990. Doctors have ruled she has been in a persistent vegetative state since, but her parents believe she is aware of her surroundings and could be rehabilitated.

Bush's attorney Ken Connor said a jury has to establish what Terri Schiavo's wishes were before a court can decide whether her private health care wishes were violated.

George Felos, Michael Schiavo's attorney, could not immediately be reached for comment.

If Terri lives, Felos book deals fall flat, and his five minutes of fame will be over. Not only that, but his image is forever tarnished. He's ruined. He was counting on her demise so that his other book and the new one he's writing would be a smashing success. He's a monster. He has a conflict of interest because he benefits from Terri's imprisonment and death. Like I said, he's a friggin' monster.

Incidentally Pinnellas County seems a weird place. A couple of mothers who were friends would baby sit for each other's children -- turns out they were breaking the law. You can have a baby sitter come to your home but not take your child to a friend's unless that person has a license.

Her new guardian should sue the pants off of the HINO and his minions for not letting Terri be stimulated. The HINO wouldn't even get her wheelchair fixed.

The testimony from that nurse who said Michael used to go in her room and shut the door and later there would be a change in her condition. Maybe that's why Michael went to school to become a nurse so he could learn how to use drugs to get desired results. He wanted her dead so bad.

I don't think he'll be allowed to kill her now. Too many people watching. Although I put nothing past that monster.

Ed, the last time One_Particular_Palpatine was losing an argument in regard to the Schiavo case, he posted a hysterical thread opining that anyone critical of Michael Schiavo might well be setting themselves up for a libel action.

He went so far as to present his opinion in that matter as a 'gift' to the forum, and was blathering about being a lawyer himself. The trouble is, he was lying and used the post to try to silence people who opposed his opinon on the Schiavo thread. And though his ego was gratified by hundreds upon hundreds of posts, and though some initially took him seriously, his lie was eventually exposed.

On the same thread, some FReepers, including me, began to suspect that One_Particular_Palpatine was in fact posting under an alias, and had in fact once been a controversial member of FR whose voluminous (and self serving) posts were somehow expunged from FR under mysterious circumstances.

Attempts to get OPP to confirm or deny this fact were met with silence: he fled the thread, like a schoolgirl.

I was then showered with abusive FReepmail by his cohorts (or, perhaps even by OPP himself under an alias, I can't be sure), and eventually got from him a two word, sexually suggestive vulgarity in response to my repeated insistence that he 'come clean'.

The point is that One_Particular_Palpatine must not be taken seriously. His posts are meant to incite and inflame and come from no intellectual basis. As evidenced by my referenced thread above, the guy will do anything to win an argument including posting a factually and intellectually vacant scare-piece to shout down his opponents.

Oh yeah, he also mocked the CBS Boycott of the Reagan movie and posted a thread trying to stop it.

I invite you to ping your list to this post so that all may see who and what this person is, and make their own judgment down the road as to how they will deal with One_Particular_Palpatine.

When the people make their wishes known at the ballot box and a judge overturns it; when their elected officials pass laws which judges overturn, then we have an Tyranny! A country run by tyranical judges! The "people" can not have what they want! It is a country no longer, "for the people, by the people"...it is for the rich and powerful by the judges.

I sent them the LKL text and pointed out several contradictions. I think we should all send them solid research and facts. Let's not send innuendos and emotional pleas.

Good for you. It's hard not to be emotional, though. I told them that I used to work with Deaf-Blind people (like Helen Keller). I suppose the HINO and his lawyer want to do away with "undesirables" like Deaf-Blind people, too. Did you know that in Seattle the Deaf-Blind people can ride the bus and go on outings and work and play and have sweethearts. It just takes more planning and work and commitment. Oh, and by the way, Deaf-Blind people can go on line and read stuff from the computer in braille. I wonder if there are any Deaf or Deaf-Blind FReepers and if so, I wonder how they feel about Terri being starved to death?

Un-friggin-believable! Well, I guess it's a good thing no one arrested me when I did the same when my children were young. We called it bartering back in my day. One person took a few kids one day, and then the other would return the favor by providing the same thing in kind. Wow!

Hey, can I sue all those other moms who let their kids come over to my house after school and play in my yard or house, eat my snacks and drinks that I provided, and then when dinner was ready they'd all disappear? I was left with a messy house and dinner late on the table many times!

Oh, he'll finish the book. All that time and money down the drain, I don't think so.
He'll end it saying, my soul and Terri's talked and somtimes she'd scream LET ME GO. I could have followed her wishes but Jeb Bush and some freepers got in my way.
The whole room was shaking when she said this to me and I thought the ceiling would fall in cause God has told me how powerful I am.

Do too -- some of them. Cabbages and rutabagas are the worst. They hate each other. They drink a few brewskis, call each other bad names and stay up all night playing "Dueling Hip-Hop" on their boom boxes. I hate it when they do that. I had to subdue an unruly zucchini once by physical force.

As a matter of fact, here's the latest from the front lines of Terri's fight. Pat Anderson, the Schindlers' attorney scheduled a deposition for tomorrow of the doctor re: the fractures. Felos tried to block the deposition and a judge without Pat Anderson's knowledge went along with Felos and was going to prevent tomorrow's deposition. Pat went to another Judge who ordered that the deposition of the doctor would take place tomorrow. Felos is still up to shifty moves.

By the way, Terri was in a chair until about 7:15 pm tonight. She's doing fine. Sorry I don't have the Judges' names.
