Senate Democratic staffers and a judge appointed by President Carter made extraordinary efforts last year to ensure that a liberal majority sat on the federal appeals court that heard the Michigan affirmative action cases, according to internal Democratic staff memos.

I think that has crossed the minds of many here at FR. Idealogy has primacy over the Constitution as far as the left is concerned. It took time of course, but finally they got enough idealogical judges in place who agree with them. It is equivalent of an overthrow, albeit at a snails pace. And look at all the b@stard Democrats who have gone along with this for decades. Republican leaders still don't understand.

The Sixth Circuit scolded Boyce Martin for his irregular handling of the Grutter case some months ago. I wonder if it would now be possible to move for more serious sanctions than a scolding.

I think the memo indicates a strong possibility that the Committee (or some of its members and staff) played a role in it. Enough evidence to warrant a grand jury investigation...and IIRC we've seen only 3 of the purported 6 memos so if any of these relate to the 6th Circuit cases, someone might be getting very concerned right now.

If this thing happened in "civilian life," there would be a RICO investigation and a lot of convictions with heavy sentences. Can't something like that happen with the exalted Senate?
