Lawyer: Accused husband's ex-girlfriend not subpoenaed

MODESTO, California (CNN) -- A lawyer representing Amber Frey, the former girlfriend of accused murderer Scott Peterson, said Friday that she has been served with documents from the defense but that they did not appear to call Frey to testify in a preliminary hearing.

You never know with Gloria. She may be doing some creative "interpretation". BTW, is the court in session today?

I thought the preliminary was held solely to determine if the defendant should be bound over for trial. I can't imagine a basis for Geragos to call her.
