Sorry, Mr. Atheist, but the way I read it is that Congress shall make no law prohibiting the free exercise of religion.  That's exactly what I think has happened here.-Owl_Eagle

 

Well, the way I read it is that Congress cannot make a law that prohibits someone from a practice that his or her religion requires of him or her. -SuenTsn

 

The problem with your interpretation is that it brings some explicit assumptions that The Framers didn't include or likely intend.

 

I also think that everyone in the U.S. has a reasonable idea of what Christian teachings are already.-SuenTsn

 
Fortunately, that's not the litmus test we use to decide which religions it's alright to discriminate against.

Lost me. I agree with Roy. But I think he fought it wrong. This battle is over but the war is still hot.

I don't need symbols for my faith. But the continued removal of symbols is very disturbing to me. Roy cares more about the country than the ACLU or the SPLC.

I'll be interested to see what Roy does next.

This is a state's rights issue and the Federal Gov't had no business pushing its agenda. The Constitution according to an 'original intent' interpretation is quite clear. It prohibits the Congress from establishing a national Sect. It does not prohibit a state from erecting religious monuments. I suspect Judge Moore expected his state to back him, but it didn't. It chose to surrender to the Feds. I've lost all respect for Pryor. It is clear that once on the Federal Bench he'll relish the ability to pound the states.

Almost every court room in the country has the ten commandments sitting in it somewhere. It's even sitting inside the SCOTUS court room. The whole thing is bizarre, but the real issue is abortion, and for that reason this case has the potential to become the rock upon which the lever can be placed to reverse Roe V. Wade. Liberals should have quit while they were ahead. Continually pushing the envelope now will only aggravate the backlash.

Roy was fine until he just plain refused obey a court order. A judge that won't obey a judge and then appeal has lost his effectiveness as a judge.

Yes there is law above the law of man but Roy is not above the law of man. No matter how misguided that law is. If he hadn't been a judge he might have pulled it off.

I am aware of how many places the 10 Commandments are displayed. Roy was singled out because he picked a fight. He really should have fought smarter. For now he is out of the fight until he finds a new venue.

Pryor need to pray for that Judgeship. I think his political career is over in Alabama. Between his 180 on Roy and his support of the failed tax plan, he has PO'd the majority of the voters.

From the very finite view of this, it would have been wiser of Roy to drop the case once he got the order, but the simple truth of the matter is that the order itself the real violation of the law. The founders were not troubled at all by the idea of conscience trumping a legalism. It was, after all, the very key idea to the start of the Revolution. Roy is nothing novel in that regard in our history, rare though he may be in our age.

I don't follow Alabama politics that closely, but I have been told that Roy is likely to be the next governor, and not before very long. Then we shall see what the governor can do about all this.

There is a wonderful history in the south of Governors giving the central government the finger, especially the overarching central government of Jefferson Davis and the Confederacy. The North has the real history of ditching SCOTUS, but it's about time to have it happen again.

If we do still have a balance of power, SCOTUS should expect to be on the give end instead of the take. I predict though that if they were pushed on this, they would fold and reverse this court, as I am sure they know this ruling is opening a door they don't want to go through. For that reason too, Roy may not appeal.

I don't know if Roy will even seek the governorship in 06, but I don't think he would win. I like his scrappiness but he could have fought it so much better. He is a bit of a grandstander and I am too but they way to have beat the overstepping feds would have been to back off and regroup.

Bill Pryor is a weather vane.

That's too far away to just wait for. Even if that is his goal I would expect he would do something in between. He could run for the House for two years before that. Or maybe something else in the state.

I have to agree. The man is just needlessly belligerent and hostile.

In the story above he's quoted, "[M]y oath of office to the Constitution requires an acknowledgment of God," he said. "It's that simple."

Now, I'm no expert on the Alabama constitution, but that seems just a bit far-fetched to me. I think he has a quite inventive and convoluted interpretation of the state constitution.

I simply have a hard time believing that any state constitution "requires an acknowledgement of God".

Court rules Ten Commandments can stay at Capitol

The 5th U.S. Circuit Court of Appeals has affirmed the state's position that the placement of the Ten Commandments monument on the Capitol grounds is not an unconstitutional attempt to establish state-sponsored religion.

Thomas Van Orden, a homeless man living in Austin, had sued to have the monument removed, calling it an endorsement of Judeo-Christian beliefs by the state government.

The state countered that the 6-foot tall red granite monument is more historical than religious, with key segments of law founded on the moral and cultural ethics provided by the commandments.

Texas Attorney General Greg Abbott applauded Wednesday's appeals court ruling.

"The Ten Commandments are undoubtedly a sacred religious text, but they are also a foundational document in the development of Western legal codes and culture," Abbott said Thursday. "The Texas monument has stood for over 40 years, and the court's decision affirms that the monument is entirely consistent with the requirements of the U.S. Constitution."

The Fraternal Order of Eagles donated the monument to the state in 1961.

You’re absolutely right to have the creeps and should be weary of anyone who tells you otherwise.

Consider that Christians don’t separate their rights from God, and keep both out of mans reach. This has kept Americans protected for more than two centuries. The Christian faith serves the heathen because he can secure the family jewels with the Christians' rights. When the federal Government starts screwing with God, they are reaching for the forbidden fruit and screwing with everyone’s rights, in order to protect atheists who don’t believe in any power above man.

Because of the atheists’ beliefs they have to believe all rights come from man and because of this they would submit to another man playing with their family jewels. That should give you the creeps.

Until this issue came up I was a Traditional American Christian only looking towards my faith when it suited me, usually at Christmas and Easter. I’m still one offensive bastard, but I no longer hide my faith. Every perversion in the world is allowed to prance around and shove their crap in my face, so the hell if I’m gonna hide my faith in the closet. If this offends people the don’t have the courage necessary to claim their place with the Brave and the Free.

Roy Moore paid the ultimate price for defying an order he believed was unconstitutional and illegal. Our courts and politicians may not believe our rights come from God but Roy did and that's why he had to be made an example of. The enemies of limited government and freedom got rid of Alabama's Chief Justice. I suspect though, their ousting him from the Alabama Supreme Court won't be the end of the matter. Far from it.

For the sake of the forum and what has happened with Moore, the alternative to the Ten Commandments—and the foundation of the Rule of Law—is godless socialism and communism. Simple as that. "Freedom" is a swiftly vanishing illusion apart from the moral foundation this country was built on. America needs to choose. Today.
