Well, Freepers it's going to be a looooooooooong day in the senate today, tonight, Thursday, and I'm guessing into Friday.
I figure we'll need a LIVE thread for this.
Looks like Tom Daschle is going to be speaking at 8:45am this morning followed by Frist at 9:11am

So it boils down to interpretation of the rule which remains formally unchanged.
I believe this is correct, however . . .
I hope they don't change the rule (via intepretation of the chair and vote to uphold his decision). If the concept of filibuster goes away (and if they do it on judicial nominations, then it's effectively gone for everything by the same method of chair ruling), the time will come when we have a Dem President and a majority Dem Senate. I don't like to think what will happen under those circumstances.
It's true that the Dems play hardball and the Republicans are wimps, but even the threat of filibuster keeps some of the most egregious travesties out. Remember Lani Guiniere? In the history of the US, the amount of time that there was a filibuster-proof majority is pretty small, and that's a good thing, because I'd rather have nothing done (until the next election, when the price for partisan politics can be assessed) than to have unrestrained government actions when the Dems are in power.

Here's the problem with changing the Senate Rules.
"The day may come when men lose all courage, break the bonds of friendship, and cease to value the fellowship of other men". When that day comes, a Democrat will return to the White House and regain control of the Senate.
When that day comes, we will need to protect the Constitution against liberal judges who think of the Bill of Rights the way a German thinks of speed limits on the Autobahn.
Strangely enough, for the long term, the moderates are right on this one. The filibuster is a tool that we must keep in reserve.
However, bear in mind that this is no endorsement of a filibuster against judicial appointments. I happen to believe that the Democrats are catering to their fundraising base, and doing so in a most craven, intellectually dishonest, fashion. But they must pay for this at the ballot box, and trust me, they will. Bush will ride these judicial nominees like a one trick pony.
And this will be worth a couple of Senate seats, I promise you.

Unfortunately the judiciary has become a political branch during the last 50 years, so the name of the game has unfortunately to get as many of OUR side on the bench as possible and, especially to capture the High Court. The pubblies have the majority now. The future can take care of itself.
