Florida Court Prohibits Terri's Parents From Joining "Terri's Law" Battle (ACLJ)

Pinellas Park, FL (LifeNews.com) -- A Florida state court on Tuesday disallowed Terri's parents from entering the legal battle over Terri's Law. They wanted to join attorneys for Governor Jeb Bush in defending the legislation that allowed Bush to ask doctors to reinsert the feeding tube that is allowing Terri to live.

Bob and Mary Schindler, Terri's parents, were represented in the request by attorneys from the American Center for Law and Justice, a pro-life law firm.

"We're very disappointed with the court's ruling," said Jay Sekulow, Chief Counsel of the ACLJ. "It is clear that state law permits the parents to get directly involved in a case to defend a state law that is keeping their daughter alive. It is unfortunate that the court did not find that the parents have sufficient legal interest in defending the state's actions -- actions that provide the only barrier between Terri and death by starvation.

Sekulow indicated the Schindlers may appeal the decision.

"We are currently examining all legal options available -- including an appeal -- for our clients. We will do everything possible to ensure that the interests of Terri's parents are represented in this case," he said.

Sekulow said the ACLJ is considering several options including filing a motion with the court to reconsider its ruling denying the motion to intervene; filing an appeal with the Florida Second District Court of Appeal; or, representing the interests of Terri's parents with the filing of an amicus brief on the issue.

In court papers filed Monday, Michael's attorneys said the legal battle is between Michael and Governor Bush and that, while Terri's parents have an interest in her well-being, they should not be a party to the lawsuit.

Attorneys for Governor Jeb Bush are expected to file a response to Michael's "Terri's Law" lawsuit this week.

The American Civil Liberties Union is aiding Schiavo in the lawsuit against Terri's Law.

Pro-life attorney Tom Marzen, who monitors end-of-life issues, told LifeNews.com he agrees the Schindlers have a right to be involved.

"The Schindlers should be allowed to intervene since their interests are certainly affected by the outcome of the suit," Marzen explained.

Michael's lawsuit also seeks a removal of Terri's feeding tube for the third time. The Schindlers' petition asks the judge to allow them to be appointed Terri's guardian in place of Michael.

Legerdemain's reasons to kill Terri:

ah, and there is the rub, deny me a feeding tube and I can still eat. Let's give her substenace without a tube and see if she eats...if not, it is time to let the body die...geesh.....it does not take a rocket scientist in this situation........

Again, I have posted this question before, where is it stated that ones constitutional rights include being force fed. Take the tubes out and let nature take its course.

Again, take out the feeding tubes and see if she can live...at this time you are force feeding her. Heck, send in the godsquad to pray when they do it..maybe a miracle will happen and she will live a happy productive life... Come on, this is a shell of a body only..

What's a year for Terri? She's not going anyplace, right?

...if she is indeed without a cerebral cortex to allow her to make the least of voluntary movements [eating or drinking], then a choice would have to be made regarding the length of time she should be kept on life support.

Terri can not eat. No, it's not that she 'can't feed herself", it's that she can not voluntarily swallow. That is the reason for the feeding apparatus; the life support.

Meanwhile.... Terri may or may not understand what's happening outside that shell of a body; a coffin of sorts. But I'll bet it's not very comfortable in there, if she is hearing anything, or can think..

If those that want to assume that Terri has the full capability to experience sound, sight, and thought...... They must also consider that Terri can not now, or ever will, respond to that stimuli. That is fact. Without a cerebral cortex, only involuntary actions are possible. There is no possibility for voluntary actions to take place. That is medical fact.

Terri is in a vegetated state and it is physically and mentally impossible for Terri to respond. She does not have that capability and she will never, ever have that capability.

I don't understand why this disqualification for guardianship hasn't been addressed before. This case is Felos' baby, euthanasia advocate that he is. If Michael's guardianship was terminated, I'm sure Felos would talk him into appealing and would likely try other legal maneuvers as well. Of course, it is possible that Felos might cut his losses on getting Terri dead (though probably not, considering he has already been writing a book about her that just isn't going to sell without the ending), but it is highly unlikely that he will abandon the challenge of Terri's Law because the stakes are so high. Florida is a virtual euthanasiacs paradise.

I'm sure Michael would have to appeal--if nothing else to buy him some time to try to cook Terri's records to at least halfway make sense. But I don't think that's likely to work, though I do wonder what's up with a Florida senate bill to remove lewd and lacivious behavior as a basis for disqualifying a guardian. Does anyone know if that has any chance of going anywhere?

Well, if he really wants to "move on", why the heck doesn't he just turn Terri over to her parents and marry the other woman? Gee. Could it be he wants Terri dead for some reason?

And hey, when you're done helping Michael kill Terri, maybe you'll feel the need to talk my aunt, who's been caring for my totally incapacitated "vegetable" cousins, Lisa and Jenny (Jenny died of natural causes at age 34, God rest her beautiful soul) for over 30 years into taking Lisa's food and water away, too...!

Eureka! I just had an epiphany! Euthanasia = more dead people in FloriDUH. More dead people in FloriDUH = more democRAT voters! It all makes perfect sense now. Sorry, couldn't help myself.
