Bottom line: Terri Shiavo has no right to due process of law. Her husband's convenience comes first.

Medicare to expand

The Schiavo controversy prompted Sen. Bill Nelson to announce Tuesday that he plans to introduce legislation that will expand Medicare to cover a single doctor's visit during which end-of-life treatments can be discussed.

The bill also would require the U.S. Department of Health and Human Services to develop a $25-million public education campaign "alerting adults of all ages about their health care options should they not be able to communicate." It would be modeled after similar education campaigns about organ donation.

Is that like the "right to privacy" in the US Constitution? I.e., a figment of a fragment of a shade of a penumbra?

I got this form-email today from Johnnie Byrd, Speaker of the Florida House:

Thank you for contacting me to express your concerns regarding Terri Schiavo. I value your input on this important matter.

During the past year, the Florida House has faced difficult choices in many areas. We have crafted legislation regarding the budget, healthcare, workers’ compensation, and prescription drug relief for Floridians. Presently, legislation is being considered to address the victims of legal dehydration and starvation deaths.

Every Floridian has a right to determine their own treatment, and anyone who has executed an advanced directive has the right to have his or her instructions carried out. Where there is no disagreement among family members, present law does not appear to create reasons for legislative intervention. However, the Terri Schiavo case raises troubling concerns that the proposed legislation would address.

The bill passed by the House in Special Session “E” on Monday night would allow the Governor to issue a moratorium to stop contested legal dehydration and starving deaths in Florida in certain instances. The moratorium would give the Legislature time to assess our current law.

With our pledge to protect the most vulnerable, I strongly believe that someone needs to be a voice for the voiceless like Terri Schiavo.

Again, thank you for contacting me. I will take your comments to heart and give them careful consideration as we address the issue of contested legal dehydration and starvation cases.

There was a rumor that Michael was in hiding because of all the death threats he is getting. He must be terrified and getting very paranoid by now. Does he play lurking games or post troll-like comments on FR?

The filing's major contentions are that the law violates Terri Schiavo's right to privacy under the Florida Constitution and the separation of power provisions of the state constitution.

Claims based on the Florida Constitution, which can be amended away. See Article XII of the Florida Constitution for the methods of amendment it allows. Turns out, it's not that hard to amend.

Michael won a $1.2 million dollar malpractice suit several years later. Shortly after he won this large amount of money, he hired a lawyer to have Terri's feeding tube removed. A large part of the money Michael won ($700,000) was placed in a trust fund to be used soley for Terri's care, therapy, and medical expenses. Michael used all the money for his personal use (a new Mercedes and house) and for his attorney's fees ($500,000). Michael currently lives with his girlfriend of 7 years (Jody Centonze) and has fathered 2 children with her. Michael also has a 12 year old child from an adulterous relationship that he had with a co-worker during his marriage to Terri. I know Terri's family personally. All they want is to take care of their daughter.

I don't believe you know them personally....I have had over 20 letters as the one above...

where are the charges and the trial in the last 13 years if he "attemped" to murder his wife...me thinks this is hype to sidetrack the issues...13 years, no charges.....won a malpractice suit against the doctor.....things don't stack up. Bottom line, he is her husband, he knows her wishes, he should be able to pull the tube...and he will after the court challenges. If not, it will be a sad day of legislative and judicial gerrymandering.

I am still trying to find out this:

Did Michael R. Schiavo or did he not dehydrate and starve his poor parents to hasten their death? In the Monday night interview with Larry King he seemed to have indicated that he had done so, but he was somewhat unclear on that point. I suspect that he has not starved the parents, but if he did, wasn't he "dumb" to admit that he had done so on national television? Of course, he was defending how "painless" is dehydration and starvation for the "PVS" patient. I bet he has no "living will" that authorizes starvation and dehydration for himself should he become PVS!

Larry King failed miserably to ask the proper questions. If anyone else had done his interview as poorly as King, he would have lost his show.

What happened with the guardian ad-litem? The five-day period for this appointment has more than lapsed. Demers is not following the new FL law!!!!! Perhaps Demers should be removed from the bench now for violating state law. This case can still result in a disaster for Terri!

Deborah Bushnell, another lawyer for Michael Schiavo, asked Chief Circuit Judge David Demers Wednesday to delay the appointment until the constitutional questions are settled.

Boy, they are really running scared. That's the libs, hurry, hurry make a mistake before the truth comes out

So, Terri's right to privacy is being violated? What about this portion of the Florida Constitution:
All natural persons, ... have inalienable rights, among which are the right to enjoy and defend life ... No person shall be deprived of any right because of ... physical disability.

Michael Schiavo has been battling in court for years to carry out what he says is his wife's wish to not be kept alive artificially.

I suppose Michael Schiavo also presumes to know it was his wife's wish not to receive any therapy/rehab for for the past ten years, to have her put in seclusion, and to not allow her family access to medical records so that they may be comforted in knowing that "there's absolutely nothing anyone can do for her."

I also suppose that since Michael Schiavo is only doing things that Terri would want him to do, she'd also be happy with his living with a woman who's now expecting his child.

After all, Michael Schiavo is only interested in what's best for Terri.
