Fla. Lawmakers May Pass Tube-Feeding Law

October 20, 2003 07:17 PM EDT

TALLAHASSEE, Fla. - Florida lawmakers were moving Monday to consider intervening in the case of a severely brain-damaged woman whose feeding tube was removed last week by her husband's order.

The Florida House scheduled a Monday night session to take up the issue. In the Senate, President Jim King said he will propose legislation that would give Gov. Jeb Bush the authority to order the feeding tube be reinserted to keep Terri Schiavo alive.

The tube was removed Wednesday following a decade-long court battle between Schiavo's parents and their son-in-law, who contends that he is carrying out her wishes not to be kept alive artificially.

"If we are to err - because time is of the essence - for goodness sake let us err on the side of caution," said King, a Republican.

Schiavo has been in what doctors call a vegetative state since her heart stopped in 1990 from a suspected potassium imbalance.

Bush told parents Bob and Mary Schindler last week that his staff would search for legal ways to save their daughter's life, but said Monday they haven't yet found a way.

"The legal ways, the remedies, don't exist," Bush said Monday, before the possible legislative moves became apparent.

Bush added, "I wish I could wave the magic wand and resolve this but every effort that we've had or every effort that has been proposed has either been thwarted by the courts or would be inappropriate."

Meanwhile, in a statement released through his lawyer, husband Michael Schiavo said Monday that he, too, is grieving, but "I did what I believe Terri would have wanted me to do."

I've seen the video, even though I don't have a TV, and I think that what's happening with this woman is apalling. I don't understand how there could even be a question about the right thing to do in this case.

I think I heard it would put a moratorium on all pending cases while they discuss it. That's the ONLY thing that would make *sense,* but don't assume it's true that they did the thing that would make sense.

We have to wait for the Florida Senate to vote.

Then the bill has to be signed.

Then who KNOWS what obstructions the other side will come up with...they don't have to do things legally, they only have to stall.

"Tomorrow at 2 pm will be 6 full days."

Actually, I heard her last 'meal' was 6 hours prior to that. They only 'fed' her twice a day, which I will double-check, but I believe MAY (I repeat, MAY) be a violation of either state or federal regulations that patients be fed 3 times a day.

I'd like to see a new lawyer represent the family. The one that have has her heart in the right place, but she is not a very good advocate for the family.

Agreed there. But the real problem is Lord Voldemort. Any actions in this case have to go through him, and it takes an exceptionally good lawyer to take on a corrupt judge, and Terri's lawyer has already made too many mistakes.

The appeals system provides zero check against corrupt judges. It's like adding an Instant Replay rule to football where the only thing the Replay Judge can do is observe whether an official was standing in the right place when he made a call and, if he wasn't, order him to stand there and make a call again.

Maybe Lord Voldemorte (grin) will get the flu and have to have his cases remanded to another court for a few weeks.
