Open letter to Gov. Bush on Terri Schindler-Schiavo

Dear Gov. Bush,

You have before you the most important decision of your political career: Will you or will you not uphold your oath of office to protect the constitutional rights of Terri Schindler-Schiavo?

Additionally, many of our readers have asked questions which, frankly – as reasonable as they are – I don't know how to answer them. Perhaps you do. For example:

1. Why is it that a governor can commute the death sentence of a person convicted of murder, but cannot stop the execution of an innocent young woman?

2. By the definitions of "cruel and unusual," our courts would not allow a convicted murderer to die of legally sanctioned starvation and dehydration. Why are you allowing this to be done to an innocent young woman?

3. If any person in America tried to euthanize their dog the way you are allowing to be done to Terri Schindler-Schiavo, they would be prosecuted for cruelty to an animal. Why are you allowing this to be done to an innocent human being?

Gov. Bush, I must also tell you that your pitiful attempt to make people think you are impotent to act in this matter is not credible. It makes people think you are acting in bad faith – washing your hands of a difficult matter just as Pontius Pilate did with Jesus 2,000 years ago. If such is the case – and I believe it is likely – you sir are a coward without modern-day peer. I hope I'm wrong. But, if you let this woman die, her blood is on your hands.

Oh, and yes, Gov. Bush, I am aware there may be a special session of the state legislature that might include a bill to address this matter. But the simple fact is you already have grounds to take charge now. By the time this "special session" gets done, Terri may very well be dead. But then you'll be able to shrug your shoulders and give yourself and the legislature enough cover to pretend you really tried to help Terri, right?

Surely, governor, there are ample reasons to warrant investigations into the activities of the people involved in seeking Terri's death. And surely there is ample evidence that Terri is no more a vegetable than you are, governor – she laughs, she cries, she moves in response to words and other stimuli. She is awake. She is alive. And she is a citizen of your state who is entitled to the full protection of the law.

Terri Schindler-Schiavo is being denied her right to life. She needs help to be rehabilitated. She does not deserve a painful execution that we wouldn't even subject dogs or criminals to.

So, governor, will you act honorably and uphold the integrity of your oath of office or will you allow an innocent, helpless woman to be murdered by legally mandated neglect?

The world is watching.

Not only that, but law enforcement has said that the problems in this case include the fact a criminal complaint was never timely filed in the right jurisdiction. The NYT claimed law enforcement has refused to investigate now.

And, just last Friday, the judge refused Terri's parents request to compel an investigation.

Without a complaint, ability of law enforcement to legally undertake an action, or a judicial order, how Gov Bush is supposed to suddenly, on his own, start and conduct a criminal investigation is a little out in left field.

It sounds to me like Terri's parents should have gotten better advice on how to start a criminal investigation -- and gotten such advice a long time ago. That doesn't mean my heart doesn't break for her - my heart does break for her.

A governor who orders the state national guard to remove Terri by force and place her in a secret, guarded location in defiance of a corrupt, activist judge would be on the fast track to be the 44th President of The United States. (Hi, I'm Mr. Rogers. Can you say, "landslide?" I knew you could.)

As I have said previously elsewhere, what you and your buddies fail to understand is regardless of the forum, you are in the minority. Many thousands of people do indeed care about Terri and what is happening to her.

Everybody cares about Terri.

And, you're wrong, YOU are in the minority of those who are advocating that Jeb Bush simply ignore the judicial branch in Florida.

Why didn't he just overrule the Florida Supremes in 2000?

I have used the term 'disenfranchised' on several occasions, to characterize the scope of Terri's plight. Allow me to expand that here.

The Roe v Wade and subsequent SCOTUS rulings have effectively disenfranchised the alive unborn ... a pregnant woman has full 'right' to order that her unborn child on life support in her body be 'put down', terminated with deadly force (executed) if she so chooses. Since the court rulings have established the notion that the unborn are not citizens until born and since this grants to the life supporting woman the full right to have that child 'executed' at her choice, we see what the total disenfranchisement of an alive individual can arrive at when the strict interpretation of 'personhood' definition is applied.

When judge Greer granted Michael Schiavo guardianship of Terri, he effectively disenfranchised Terri, placed her rights at the whim of her guardian, took her right to exercise ownership and right to life at the hands of her legal guardian ... need we revisit the fact that it was Michael Schaivo whom, acting as court appointed guardian, placed the DNR on Terri's chart while she resided in a nursing facility; need we revist the fact that it was the guardian of the state statutes (judge greer) who granted Terri's guardian the right to order her put down via dehydration and starvation? I have pointed out that Michael has been defrauding his ward by committing adultery that breaches the fealty laws of the state of Florida. Defrauding someone for whom you've been appoint the holder of life and death decisions is a very serious miscarriage of the guardianship laws in the state of Florida. I will not revisit the fact that the governor can suspend the execution of a ruling that he believes is in error while an investigation occurs to determine the validity in light of unexplored findings ... Jeb Bush's own amicus brief to Lazzara's court is evidence that the governor believes Terri's Constitutional rights (both state and federal) are being violated.

That's about enough taunting, sinky. The governor can order his law enforcement people to NOT EXECUTE a suspect ruling while an investigation is conducted, especially where that suspect ruling has irreversible consequences if carried out. You know that, sinky. [As to your irrelevant query regarding the governor cancelling the fla Sc ruling in 2000, you may recall he had the legislature standing at the ready to revisit the writing of law and the flasc unconstitutional abbrogation with their cherry picking, right?]
