Schiavo's supporters push Bush to intervene The governor says he's troubled by the brain-damaged woman's situation, but it's unclear if he has the legal right to get involved. By WILLIAM R. LEVESQUE, Times Staff Writer Published October 17, 2003
--------------------------------------------------------------------------------
PINELLAS PARK - Terri Schiavo's weary parents kept vigil by their oldest child Thursday as they awaited word from the governor on a strategy to save her.
Activists pressuring Gov. Jeb Bush to intervene submitted to the governor's office several legal opinions from lawyers telling Bush he has the constitutional right to force doctors to resume feeding Mrs. Schiavo.
Late in the day, Bush told reporters that his lawyers were still working on a solution. But he admitted they have found nothing.
"If not, she's going to starve to death. I'm sorry, to me that's troubling," Bush said after a news conference on teenage drinking and drug use. "I just wish I could do something about this."
Legal experts, meanwhile, expressed doubt that Bush has any option to force doctors to reinsert the feeding tube removed from Mrs. Schiavo's stomach at 2 p.m. on Wednesday.
"In a nutshell, it really isn't the governor's official business," said University of Florida law professor Joseph W. Little. "There is absolutely nothing in the state constitution that gives him authority in this matter or a duty to do anything about it."
Professor Mike Allen, who teaches constitutional law at the Stetson University College of Law in Gulfport, said a separation of powers prevents the governor's intervention.
"Maybe my view is a bit jaded," Allen said. "But I suspect a good portion of this is a public relations effort by the governor."
Mrs. Schiavo's parents, Bob and Mary Schindler, visited their 39-year-old daughter through much of the day, exhausted by the constant media attention.
"We're tired," Bob Schindler said in the morning. "We're just going to wait and see what happens."
As the parents wait, Mrs. Schiavo's husband, Michael Schiavo, has moved out of his Clearwater home along with his girlfriend and their 1-year-old child after death threats, said Michael Schiavo's attorney, George Felos.
Threats received by letter, phone and e-mail in recent days have been reported to authorities.
"We've gotten a lot of calls, mostly people blowing off steam," Felos said. "These threats, however, were viewed to be credible."
Felos also issued an invitation to Bush to visit with Mrs. Schiavo and her husband at Woodside Hospice. Bush's office has yet to respond.
"The governor seems to be under the misapprehension that Terri can be fed by mouth," Felos said. "That is not the case. If the governor isn't just using this case for political purposes and he's interested in the truth, we invite him to visit."
Michael Schiavo petitioned the Pinellas-Pasco courts in 1998 to remove his wife's feeding tube because he says she cannot recover from her vegetative state. The parents disagree, saying she might regain, the ability to eat and drink.
A judge sided with Michael Schiavo after a trial in 2000, at which he testified his wife told him several times during their marriage she would not want to be kept alive by artificial means.
Mrs. Schiavo has been severely brain damaged since she suffered cardiac arrest in 1990 from what doctors believe was a potassium imbalance.

Terri Schiavo's parents could never have imagined
Posted: October 17, 2003
Kevin McCullough
Being a newly married husband myself, I often wonder what it will be like to take my future daughters on walks to the park. To see them run and pick flowers. To see them chase butterflies. Or, when they are all tired and worn out, I wonder how many times they will come say to me, "Daddy carry me, please, I don't want to walk anymore."
This week, I wonder what Bob Schindler imagined as he was raising little Terri. I wonder if he ever imagined his little girl would ever grow to be too big for him to hold. I wonder if he ever imagined that when she was grown and having survived some incredibly horrid circumstances that his touch and his holding her would so tickle her with delight that she literally bursts out laughing.
I wonder what my wife will tell our little girl in the evenings as she brushes her hair for her before she goes to bed. What kinds of things will they share as secrets between mother and daughter. I wonder what kind of dreams they will discuss and ponder. Will it be fanciful tea parties and dollhouses and will they dream together about that day when she marries.
I have wondered this week about Mary Schindler as the news goes by day after day.
Did she tell secrets and dream dreams with little Terri as she was growing up? Did she sit on the edge of her bed and brush her hair and tell Terri things about life, or cause her to feel like a princess? How many times did mother and daughter sit and cry over a romantic movie together, or laugh uncontrollably because they saw humor in the same things?
Did Terri Schindler grow up pleading with her mom to get her a pretty lace dress for Easter? Did she give Mary a hard time as a teen-ager? And when Terri had her heart broken by her first love, did Mary's heart break with her?
Did Robert Schindler imagine that when Terri told her that she had found the man she was going to marry that he would do anything other than protect her? As the day approached, did Mary and Terri get into small arguments about the look of the dress, the location of the ceremony, or how many people to invite? When the day arrived, did it ever occur to anyone sitting in the audience that "in sickness and in health" meant exactly that?
Could the Schindler's have ever imagined that the call would come one day in 1990 alerting them to the fact that Terri had suffered a massive heart attack? Could they have imagined the hours of pain and waiting hoping in those few weeks that Terri would be her old self again?
Could they have imagined the grief at the reality that Terri would never be able to care for herself again? Did they imagine the pain that Terri went through in having the feeding tube that would give nutrition and health to Terri's body? Did they imagine that Terri's husband Michael would receive a large settlement for Terri's injuries?
Could they have imagined that, according to reports in the Washington Dispatch, Michael Schiavo would begin an extramarital relationship with another woman and father two children by her all while remaining married to their Terri.
Could they imagine that most likely because of his extramarital interest and the substantial cash settlement he had received that their Terri would have become such a nuisance to Michael that Michael would wish her dead? Could they have imagined that judges in the United States of America county probate Judge George Greer, District Judge Richard Lazzara and the Florida Supreme Court would find Terri to be "a life not worth living"?
Could they have imagined their little girl's plight becoming so serious that it would be necessary for their governor to step in and try to help on their behalf?
Could they have imagined that these same judges would also restrict their final few days of opportunity to visit with or see Terri, to take pictures, final video of her? Could they have imagined that because the court had ordered them not to give "therapeutic support" and barring them from video taping, that they themselves would have to defy a court order for the public to see that Terri was not brain-dead?
Is it fair or proper for this son-in-law to try to deny the rights of Terri's parents to tell the truth about Terri's condition? Shouldn't people know that when Terri's mom walks into her hospice room and calls her name that Terri's eyes widen with joy, a smile comes on her face and she tries to sit up? Shouldn't people know the truth that when Terri's mom nuzzles with her and kisses her on the cheek that it tickles Terri's heart so much that she breaks out with laughter? Shouldn't people know that Terri began to cry when she was told of what was going to happen to her.
Could we ever imagine that the day would come when someone would be allowed to starve and dehydrate to death simply because they had become an inconvenience to the husband who had promised before God and man, "in sickness and in health"?
When Mary Schindler was brushing Terri's hair out at night when she was little could she have ever dreamed that Terri's future husband would prevent her from being with her in the final 10 days of life?
Terri began starving two days ago. Doctor's say she will be dead within 10 to 14 days of when it began. Download the video yourself and watch Terri delight with the tickle of a feather. Read the account of how she responds to her parents.
It frightens me to think this is the state of where we are today. Could you ever have imagined?

It's now 9:45 in the morning in Florida, and there sure isn't much updated news being posted. Where is the Governor? What's happening inside Terri's room? Are her family with her?
I'm frustrated. I'll be in Florida on the 29th. Too late to matter.
BTW, I really like your tagline. Very sage.

With a complicit judge with an evident right-to-die agenda, a lawyer with same agenda, the husband who wants to kill his wife has no legal opposition.
This is one more case of changing the law through the court system. The judge appears to have a right-to-kill agenda, as does the obvious one by the lawyer Felos. Terri is to be a sacrificial lamb on the alter of euthanasia.
This plays right into the hands of the Michael Schiavo who cannot wait to kill Terri. The common media presented angle that he is only honoring the wishes of his wife would be laughable, were it not so deadly. Quite the honor to one's disabled spouse by committing adultery. Oh, but I'm sure he would tell us Terri said she would want that too. The bottom line is that Michael's actions in real life contradict the his reasons for having Terri killed.
People in the court have an agenda to fulfill, the 'husband' has his own probable criminal interests, and Terri is their lamb. Terri has a constitutional right to life, regardless of physical disability. How does one get around a constitutional right like that? Deem her subhuman.
This is about the court ordered ownership of another human being, and perpetrated by the court's opinion that she is less than human. Humans have rights, rights that prevent their killing by starvation. It has been decided that Terri is not human and can be killed thusly.
Some, including Jeb, try to wrangle with laws about guardianship, voiced wishes' legal standing, etc. when this boils down to protecting another person's basic rights.

Wish I could be there. I'm fasting, praying and e-mailing waiting on Jeb. He will do something this morning. At least he'd better! As for the scum bag..does he really think there is any place he can hide? I didn't mean that as a threat, just knowing that sometime, somewhere he will pay for this.
To: kenth
Very true, and eloquently written.
In a way, I'm kind of glad I won't be around in 20-30 years when the courts start selecting elderly or disabled people on a regular basis, and deeming them "too unproductive to be allowed to live." It WILL happen, and what is happening right now is setting THAT precedent.

I hope he does do something this morning too. I cannot thing of anything that is more important on his agenda. I would even issue an executive order to feed her and face the consequences later. Who could fault him for that? The issue I brought up earlier about the Catholic Church. I am not Catholic and do not know what constitutes the guidelines for an annulment. But, it would seem that adultery and abandonment would. Why could not the Church do that today? Or am I being unrealistic?

A lawyer friend of mine wrote this:
"I'm no expert in this area, but I think a federal writ of habeas corpus would have to bypass the Florida judicial system and make a rapid end run through federal channels."
Can someone explain the above to me and can it be done? Thanks.

I'm curious if he had enough money and a good lawyer and got the same judge again, could he stop feeding his kid if he had Cerebral Palsy? Is this the start of a Nazi-like genocide where we can just neglect our handicapped? Sick Sick Sick

I hate to say it but Terri is surrounded by armed guards.
I was there for the prayer vigil Monday, Tuesday and Wednesday and there were no fewer than 4 police cars
in the Hospice driveways at any given time 24 hours a day.
One hopes that no other crimes were being committed in Pinellas Park, as the police force was seriously distracted!

OMG, armed guards to protect their right to murder her? This country is falling apart at the soul. :**(
To: Autie
Unfortunately, there are no instant annulments. It would have to before a tribunal with all sorts of documentation. I'm pretty sure there's nothing in Church law to cover a case like this where you'd need one fast. :-(
To: Autie
"The governor seems to be under the misapprehension that Terri can be fed by mouth," Felos said. "That is not the case. Given that you've persuaded a judge to order that no attempt to feed Terri be made, Felos, and you have armed LEO's there to make sure no attempt to feed Terri can be made, yeah, you're right, "that is not the case".
What a weasel.

I assumed Soylent Green was your reference to the movie with Charlton Heston, survival of the fittest.

Yes, it was referring to the film. But you are wrong about it being about survival of the fittest. It was about government deciding who should die and when, based primarily on age.
Have you seen the film?

I watched it a long long time ago. All I remember was that people were killing each other because there was no food and everyone was surving on "soylent" made by a corrupt executive who ends up meeting his maker in the end.
