PINELLAS PARK, Fla. - The parents of a severely brain-damaged woman and others fighting to keep her alive stepped up the pressure on Gov. Jeb Bush to intervene in the case Thursday.
The feeding tube keeping Terri Schiavo alive was removed Wednesday, culminating a decade-long legal fight between her parents and her husband. Doctors say she will live as long as two weeks without it.

The brief filed by the Governor sets forth significant reasons to believe..the law is... being violated because Terris right to life is violated by the state when the state, acting as her guardian, assumes that her wish to live without artificial sustenance is the same as a wish not to be fed at all. The state has an unqualified interest in life. Moreover, Terri is being denied oral sustenance, which creates an unnecessary conflict with Florida Statutory law by implying that physicians may cooperate with a persons alleged express wish not to feed herself . . . . A denial of Terris right to life under these circumstances, it appears, results in a violation..
Explain again how legally this is moot?

This poster is in this thread only to stir up the pain and emotions of others who are devastated by the Florida debacle. He seems to be revelling in pouring salt on the wounds of those who care about Terri, and are in this thread to discuss the events as they play out. This thread is not intended to be a compative thread. We are witnessing what WE see as abject tragedy, and this rude person is gleeful in his disruption of the thread. I'm sure we would all appreciate it if you would have a word with him and convince him how inappropriate his behavior here is.

Explain again how legally this is moot?If the Florida SC refused to hear this (twice), and the USSCOTUS refused to hear it in 2001 (quoting info from another poster who mentioned some of the legal background), it would seem that all of the numerous judges who have reviewed the case, have come to the same conclusion. I.e., followed stare decisis, and the laws already on the books.

Hers was terminal, and she didn't want any resuscitation. She just wanted to go. That's what her living will requested. It broke my heart to watch her waste away, but it did end quickly, and she was medicated for pain.

It's a terrible situation. I don't agree that a judge should have the last word. But if I were in her condition I'd rather die.

Being how my grandmother was a probate attorney who headed any questions any attorneys had at the Van Nuys court house, and she also wrote the legal secretary handbook with another judge for the state of California, and the fact that I have study and taken some law courses myself, I would say you have NO IDEA WHAT YOU ARE TALKING ABOUT!!!!
One thing you learn in law is that there is NO LAW! Two identical cases could have two different outcomes. But this case is the exception SOMEONE knows something or was PAID off. And all of your dribble is not going to change things. Just don't try it yourself you may not get away with it.

Feeding her anything without a physician's recommendation would be an incredibly stupid thing to do. Isn't one of the problems that she cannot swallow?Terri can swallow. Nurses and therapists have testified to this; and, the fact that she doesn't drool is further proof.
The question is, could Terri swallow food? Therapists have said yes, she almost certainly could with training.
I wouldn't put too much stock in Schiavo's "physician's recommendations," particularly when some "physicians" seem quite keen on having their patients die ASAP.

Legal standing? Where in the constitution say that constitutional rights are suspended if someone's husband says so. Michael Schiavo has no legal standing to suspend the consitution.
