Now I'm confused. Either Jeb jas authority or he deson't. People have short term memories and if anything sticks it will be financial issues or healthcare - something that affects them directly.

Don't get me wrong I'm not attacking you. I fear though that your prediction will come true.

The family is parents are pursuing it because they have nothing else left. They've been turned away in every legal venue they've pursued. They want to believe that someone can help them, and they will keep pushing at any door that even seems to be cracked open until the very end -- which I'm afraid is probably just a few days way.

I'm a little confused by this question. Lawyers write briefs all the time that have little or no chance of prevailing. They do it because someone is desperate enough to pay them to do it, or because they want a forum to express a minority point of view to their legal brethren or to the public, or because they really believe what's in their brief and can't bear to stand by and do nothing, even though they know they are almost certain to lose. But just because a lawyer writes a brief, that doesn't mean that he will get the outcome he wants. Even if Jeb Bush agrees with this arguments (and I assume that he is sincere) if his own legal staff is telling him that the arguments have no legal merit, that sharply limits what he can do.
