Can the Democrats stop the recall by using back door maneuver?

It's Oct 1, and Davis knows that he can't possibly beat the recall. He also sees in the polls that Bustamante will not be elected. He resigns, making Lt. Gov. Cruz Bustamante the new governor. Since the recall effort was to replace Davis, and Davis had been replaced, the courts decide to cancel the recall election. Bustamante serves out the rest of the term. Can this tactic work?

No. The law says they have the election anyway and choose a new governor. They foresaw this kind of trickery.

We are recalling the office not Davis. Cruz would serve until Oct election nothing more.

From what I understand, Davis' resignation would not halt the recall. This provision was built into the 1911 law.
