Something's missing from this story. In order to show someone's image publicly, as in a video, a signed release needs to be obtained. I may be wrong, but I'm fairly certain the producer of this video has maintained he has a signed release from this woman. She simply decided in retrospect that maybe conducting herself in this manner on video wasn't such a good idea and is now suing to try to stop it.
If I'm wrong, please correct me.

The real, relevant issue is "RELEASE FORM". If it is not a news show, the producers are really supposed to get one. I've signed these myself, but you know GGW producers don't do this. I believe the GGW series is a "documentary."

Hmmm, she doesn't look like she's doing it with ANY reservation whatsoever...did she think that no one in the crowd had a camera???? How did they invade her privacy??? She's in a public place flashing her hooters....if she'd taken a picture and sent them to one person on the expectations that it was "privelaged", that'd be different...but, umm, I've been to Havasu, there's nothing private about it.
She got what she deserved. I do think, however, they should have to renumerate her for the use of her image without her permission, but it's not an invasion of her privacy at all.
And, "boys, it is not accepted normal behavior...if you asked me to show you my t*ts, I'd deck you!

You are correct...both of you...unless it's an accepted news show, you must get a signed release for any form of media.

unless it's an accepted news show, you must get a signed release for any form of media. HBO does those "Taxicab confessions" show. They get releases signed cause they are using hidden cameras and the "victims" (participants) have an expectation of privacy when talking with a taxi driver inside of a car.
A woman who lifts her shirt in public has no expectation of privacy. One who sees a camera and still does so has even less of a claim to having her privacy invaded.

She has no expectations to privacy, but the producer of GGW also has no right to profit off the explotation of her body...show it nilly will for free, fine, but not profit from it.

I hardly consider GGW a documentary...he might like to think it's that, but it's no more a documentary than Michael Moore's "Bowling for Columbine".

It's entirely documentary. It documents how gullible drunk girls can be.
Seriously, it is a glimpse into the party world of Mardi Gras and Spring Break and such which literally documents the activities.
SD
To: SoothingDave
I suppose. It's probably more factual than Michael Moore's piece of trash.

It's probably more factual than Michael Moore's piece of trash. Absolutely. I don't think much of GGW is scripted and staged.
I am being somewhat facetious in calling it a "documentary," but that is in essence what it is. I think someone who voluntarily posed and is on any of these films has no recourse. But using a person's image for advertising or such promotional work should be under license.
There's a fair compromise, dont'tcha think?

She could care less about being embarrassedIs she embarassed to be a 23 y/o single mom? Is she embarassed to (probably) receive WIC, AFDC, subsidized housing and daycare, Medicaid? Yeah, I'm making assumptions there, but so what?
To: banjo joe
I don't think she's embarrassed about anything. She simply wants a cut of the pie from the sales of the video, that's all.

There's a fair compromise, dont'tcha think? Very fair! I have no pity for the rest of the girls, but that one is being used for promotional purposes...and I really have no pity for her, other than that she should be renumerated for her "work" as a "model".
As to the "damages"....hunny, don't flash people in a largely public place and then cry foul. If I flased someone in a public place, I'd fully accept the consequences of my actions.

Yes, you are making assumptions...you don't know the circumstances of her being a single mom or that she received any public assistance as such.
I am not agreeing with what she did, but that doesn't mean that she was a "white trash welfare mom"....being born & raised in Southern California and going to Havasu on many a spring break & summer time, I saw very wealthy spoiled rotten rich kids do things far worse than that. And I saw a few of those same kids later (after high school) as "single parents" mooching off their wealthy parents (and the parents probably deserved the leeching).
Let's not be liberals and judge what isn't there...judge only what we do know...she was sleezy in the act of flashing a large group of people on public lake, which she now regrets (probably only in that she didn't get paid for it and she sees how much money GGW is making) and she now wants a cut of the pie. As for any more, we don't have enough facts to pass judgement...for all we know she could be a young widow.

The boys, Cervantes said, have heard "rumors" at school about their stepmom's "Girls Gone Wild" appearance. (5 pages)
Dude, don't think about your mom like that....

You guys probably know better than me. I'd like to thing if the case is BS, it won't last a day. I hope, if you all are right, that it won't. I must say that recent court history is not encouraging.
You gotta give the plaintiff and attorney credit for boldness.
I'm probably being short-sighted here, but the worst I can see is a large cash payment to Ms. Whoever, and/or no GGW in the future.
But, correct me if I'm wrong, and please, follow my tag!
